AMENDMENT TO SENATE BILL 262

2    AMENDMENT NO. ______. Amend Senate Bill 262, AS AMENDED,
3with reference to page and line numbers of Senate Amendment No.
44, as follows:
 
5on page 85, line 22, by replacing "construction" with
6"construction"; and
 
7on page 85, line 24, by deleting "completed"; and
 
8on page 86, line 1, by replacing "5 10" with "10 calendar"; and
 
9on page 112, line 2, after "Council", by inserting
10"identifying"; and
 
11by replacing line 11 on page 112 through line 13 on page 114
12with the following:

1    "(30 ILCS 575/8h new)
2    Sec. 8h. Encouragement for telecom and communications
3entities to submit supplier diversity reports.
4    (1) The following entities that do business in Illinois or
5serve Illinois customers shall be subject to this Section:
6        (i) all local exchange telecommunications carriers
7    with at least 35,000 subscriber access lines;
8        (ii) cable and video providers, as defined in Section
9    21-20l of the Public Utilities Act;
10        (iii) interconnected VoIP providers, as defined in
11    Section 13-235 of the Public Utilities Act;
12        (iv) wireless service providers;
13        (v) broadband internet access services providers; and
14        (vi) any other entity that provides messaging, voice,
15    or video services via the Internet or a social media
16    platform.
17    (2) Each entity subject to this Section may submit to the
18Illinois Commerce Commission and the Business Enterprise
19Council an annual report by April 15, 20l8, and every April 15
20thereafter, which provides, for the previous calendar year,
21information and data on diversity goals, and progress toward
22achieving those goals, by certified businesses owned by
23minorities, women, persons with disabilities, and
24service-disabled veterans, provided that if the entity does not
25track such information and data for businesses owned by
26service-disabled veterans, the entity may provide information

1and data for businesses owned by veterans.
2    The diversity report shall include the following:
3        (i) Overall annual spending on all such certified
4    businesses.
5        (ii) A narrative description of the entity's supplier
6    diversity goals and plans for meeting those goals.
7        (iii) The entity's best estimate of its annual spending
8    in professional services and spending with certified
9    businesses owned by minorities, women, persons with
10    disabilities, and service-disabled veterans (or veterans,
11    if the reporting entity does not track spending with
12    service-disabled veterans), including, but not limited to,
13    the following professional services categories:
14    accounting; architecture and engineering; consulting;
15    information technology; insurance; financial, legal, and
16    marketing services; and other professional services. The
17    diversity report shall also include the entity's overall
18    annual spending in the listed professional service
19    categories. For the diversity reports due on April 15, 2018
20    and April 15, 2019, the information on annual spending with
21    certified businesses for professional services required by
22    this Section may be provided for all professional services
23    on an aggregated basis.
24        (iv) Beginning with the diversity report due on April
25    15, 2020, the total number and percentage of women and
26    minorities that provided services for each construction

1    project in the State.
2    An entity subject to this Section which is part of an
3affiliated group of entities may provide information for the
4affiliated group as a whole.
5    (3) Any entity that is subject to this Section that does
6not submit a report shall be reported by the Business
7Enterprise Council to each chief procurement officer. Upon
8receiving a report from the Business Enterprise Council, the
9chief procurement officer shall prohibit any entities that do
10not submit a report from bidding on State contracts for a
11period of one year beginning the first day of the following
12fiscal year and post on its respective bulletin the names of
13all entities that fail to comply with the provisions of this
14Section.
15    (4) A vendor may appeal any of the actions taken pursuant
16to this Section in the same manner as a vendor denied
17certification, by following the appeal procedures in the
18administrative rules created pursuant to this Act.".
