AMENDMENT TO SENATE BILL 8

2    AMENDMENT NO. ______. Amend Senate Bill 8, AS AMENDED, with
3reference to page and line numbers of House Amendment No. 1, as
4follows:
 
5on page 9, line 3, after "1-10,", by inserting "1-15.20,"; and
 
6by replacing line 26 on page 13 through line 20 on page 14 with
7the following:
8    "Notwithstanding any other provision of law, for contracts
9entered into on or after October 1, 2017 under an exemption
10provided in any paragraph item (12) of this subsection (b),
11except paragraph (1), (2), or (5), each State agency shall be
12published in the Procurement Bulletin within 14 calendar days
13after contract execution. The chief procurement officer shall
14prescribe the form and content of the notice. The Illinois
15Finance Authority shall provide the chief procurement officer,
16on a monthly basis, in the form and content prescribed by the

1chief procurement officer, a report of contracts that are
2related to the procurement of goods and services identified in
3item (12) of this subsection (b). At a minimum, this report
4shall post to the appropriate procurement bulletin include the
5name of the contractor, a description of the supply or service
6provided, the total amount of the contract, the term of the
7contract, and the exception to the Code utilized. A copy of
8each of these contracts shall be made available to the chief
9procurement officer immediately upon request. The chief
10procurement officer shall submit a report to the Governor and
11General Assembly no later than November 1 of each year that
12shall include, at a minimum, an annual summary of the monthly
13information reported to the chief procurement officer."; and
 
14on page 27, immediately below line 13, by inserting the
15following:
 
16    "(30 ILCS 500/1-15.20)
17    Sec. 1-15.20. Construction, and construction-related, and
18construction support services. "Construction" means building,
19altering, repairing, improving, or demolishing any public
20structure or building, or making improvements of any kind to
21public real property. Construction does not include the routine
22operation, routine repair, or routine maintenance of existing
23structures, buildings, or real property.
24    "Construction-related services" means those services

1including construction design, layout, inspection, support,
2feasibility or location study, research, development,
3planning, or other investigative study undertaken by a
4construction agency concerning construction or potential
5construction.
6    "Construction support" means all equipment, supplies, and
7services that are necessary to the operation of a construction
8agency's construction program. "Construction support" does not
9include construction-related services.

11on page 114, by replacing line 22 with "Sections 1.1 and 4.05
12as follows:"; and
 
13by replacing line 21 on page 116 through line 16 on page 117
14with the following:
15    "(a-10) Each chief procurement officer appointed pursuant
16to Section 10-20 of the Illinois Procurement Code, with joint
17agreement of the respective agency or institution, may
18authorize the purchase or lease of supplies and services which
19have been procured through a competitive process by a federal
20agency; a consortium of governmental, educational, medical,
21research, or similar entities; or a group purchasing
22organization of which the chief procurement officer or State
23agency is a member or affiliate, including, without limitation,
24any purchasing entity operating under the federal General

1Services Administration, the Higher Education Cooperation Act,
2and the Midwestern Higher Education Compact Act. Each
3applicable chief procurement officer may authorize purchases
4and contracts which have been procured through other methods of
5procurement if each chief procurement officer determines it is
6in the best interests of the State, considering a
7recommendation by their respective agencies or institutions.
8The chief procurement officer may establish detailed rules,
9policies, and procedures for use of these cooperative
10contracts. Notice of award shall be published by the chief
11procurement officer in the Illinois Procurement Bulletin at
12least prior to use of the contract. Each chief procurement
13officer shall submit to the General Assembly by November 1 of
14each year a report of procurements made under this subsection
15(a-10)."; and
 
16on page 124, by deleting lines 11 through 19.
