AMENDMENT TO HOUSE BILL 4643

2    AMENDMENT NO. ______. Amend House Bill 4643 on page 1, by
3replacing line 5 with the following:
4"changing Sections 1 and 17 and by adding Section 1.2 as
5follows:"; and
 
6on page 3, by replacing line 6 with the following:
7"and establishing a physical therapy treatment plan pursuant to
8such license."; and
 
9on page 3, by replacing lines 9 through 15 with the following:
10"she is educated and licensed to perform. A physical therapist
11shall refer to a licensed physician, advanced practice
12registered nurse, physician assistant, dentist, podiatric
13physician, other physical therapist, or other health care
14provider any patient whose medical condition should, at the
15time of evaluation or treatment, be determined to be beyond the
16scope of practice of the physical therapist."; and

1on page 4, by replacing lines 6 through 14 with the following:
2    "(7) (Blank). "Documented current and relevant diagnosis"
3for the purposes of this Act means a diagnosis, substantiated
4by signature or oral verification of a physician, dentist,
5advanced practice registered nurse, physician assistant, or
6podiatric physician, that a patient's condition is such that it
7may be treated by physician therapy as defined in this Act,
8which diagnosis shall remain in effect until changed by the
9physician, dentist, advanced practice registered nurse,
10physician assistant, or podiatric physician."; and
 
11on page 5, immediately below line 9, by inserting the
12following:
13    "(13) "Health care professional" means a physician,
14dentist, podiatric physician, advanced practice registered
15nurse, or physician assistant."; and
 
16on page 5, immediately below line 12, by inserting the
17following:
 
18    "(225 ILCS 90/1.2 new)
19    Sec. 1.2. Physical therapy services.
20    (a) A physical therapist may provide physical therapy
21services to a patient with or without a referral from a health
22care professional.

1    (b) A physical therapist providing services without a
2referral from a health care professional must notify the
3patient's treating health care professional within 5 business
4days after the patient's first visit that the patient is
5receiving physical therapy. This does not apply to physical
6therapy services related to fitness or wellness, unless the
7patient presents with an ailment or injury.
8    (c) A physical therapist shall refer a patient to the
9patient's treating health care professional of record or, in
10the case where there is no health care professional of record,
11to a health care professional of the patient's choice, if:
12        (1) the patient does not demonstrate measurable or
13    functional improvement after 10 visits or 15 business days,
14    whichever occurs first;
15        (2) the patient returns for services for the same or
16    similar condition after 30 calendar days of being
17    discharged by the physical therapist; or
18        (3) the patient's condition, at the time of evaluation
19    or services, is determined to be beyond the scope of
20    practice of the physical therapist.
21    (d) Wound debridement services may only be provided by a
22physical therapist with written authorization from a health
23care professional.
24    (e) A physical therapist will consult and collaborate with
25the appropriate health care professionals on conditions
26related to temporomandibular disorder."; and

1by replacing line 21 on page 9 through line 3 on page 10 with
2the following:
3"licensed physical therapist in violation of Section 1.2
4independent of a documented referral or a documented current
5and relevant diagnosis from a physician, dentist, advanced
6practice registered nurse, physician assistant, or podiatric
7physician, or having failed to notify the physician, dentist,
8advanced practice registered nurse, physician assistant, or
9podiatric physician who established a documented current and
10relevant diagnosis that the patient is receiving physical
11therapy pursuant to that diagnosis;".
