AMENDMENT TO HOUSE BILL 4594

2    AMENDMENT NO. ______. Amend House Bill 4594 on page 5, by
3replacing lines 14 through 16 with "law, the minimum fine for a
4conviction or supervision disposition on a minor traffic
5offense is $25 and the minimum fine for a conviction,
6supervision disposition, or violation based upon a plea of
7guilty or finding of guilt for any other offense is $75. If the
8court finds that the fine would impose an undue burden on the
9victim, the court may reduce or waive the fine. In this
10Section, "victim" shall not be construed to include the
11defendant."; and
 
12on page 12, line 2, by replacing "convert" with "converting";
13and
 
14on page 16 by replacing lines 12 through 19 with the following:
15        "(16) In each county in which a Children's Advocacy
16    Center provides services, a Child Advocacy Center Fund,

1    specifically for the operation and administration of the
2    Children's Advocacy Center, from which the county board
3    shall make grants to support the activities and services of
4    the Children's Advocacy Center within that county."; and
 
5on page 62, line 24, by replacing "functions" with "functions;
6however, the primary purpose shall be to finance State Police
7cadet classes in May and October of each year"; and
 
8on page 101, line 14, by replacing "Section 27.1b" with
9"Sections 27.1b and 27.3b-1"; and
 
10on page 124 by inserting immediately below line 8 the
11following:
 
12    "(705 ILCS 105/27.3b-1 new)
13    Sec. 27.3b-1. Minimum fines; disbursement of fines.
14    (a) Unless otherwise specified by law, the minimum fine for
15a conviction or supervision disposition on a minor traffic
16offense is $25 and the minimum fine for a conviction,
17supervision disposition, or violation based upon a plea of
18guilty or finding of guilt for any other offense is $75. If the
19court finds that the fine would impose an undue burden on the
20victim, the court may reduce or waive the fine. In this
21subsection (a), "victim" shall not be construed to include the
22defendant.

1    (b) Unless otherwise specified by law, all fines imposed on
2a misdemeanor offense, other than a traffic, conservation, or
3driving under the influence offense, or on a felony offense
4shall be disbursed within 60 days after receipt by the circuit
5clerk to the county treasurer for deposit into the county's
6General Fund. Unless otherwise specified by law, all fines
7imposed on an ordinance offense or a misdemeanor traffic,
8misdemeanor conservation, or misdemeanor driving under the
9influence offense shall be disbursed within 60 days after
10receipt by the circuit clerk to the treasurer of the unit of
11government of the arresting agency. If the arresting agency is
12the office of the sheriff, the county treasurer shall deposit
13the portion into a fund to support the law enforcement
14operations of the office of the sheriff. If the arresting
15agency is a State agency, the State Treasurer shall deposit the
16portion as follows:
17        (1) if the arresting agency is the Department of State
18    Police, into the State Police Law Enforcement
19    Administration Fund;
20        (2) if the arresting agency is the Department of
21    Natural Resources, into the Conservation Police Operations
22    Assistance Fund;
23        (3) if the arresting agency is the Secretary of State,
24    into the Secretary of State Police Services Fund; and
25        (4) if the arresting agency is the Illinois Commerce
26    Commission, into the Public Utility Fund."; and

1on page 124, by inserting immediately below line 18 the
2following:
3    "(705 ILCS 105/27.7 rep.)"; and
 
4on page 124, line 21, by replacing "and 27.6" with "27.6, and
527.7".
