AMENDMENT TO HOUSE BILL 3060

2    AMENDMENT NO. ______. Amend House Bill 3060 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Vital Records Act is amended by changing
5Section 1 and by adding Section 25.3 as follows:
 
6    (410 ILCS 535/1)  (from Ch. 111 1/2, par. 73-1)
7    Sec. 1. As used in this Act, unless the context otherwise
8requires:
9    (1) "Vital records" means records of births, deaths, fetal
10deaths, marriages, dissolution of marriages, and data related
11thereto.
12    (2) "System of vital records" includes the registration,
13collection, preservation, amendment, and certification of
14vital records, and activities related thereto.
15    (3) "Filing" means the presentation of a certificate,
16report, or other record provided for in this Act, of a birth,

1death, fetal death, adoption, marriage, or dissolution of
2marriage, for registration by the Office of Vital Records.
3    (4) "Registration" means the acceptance by the Office of
4Vital Records and the incorporation in its official records of
5certificates, reports, or other records provided for in this
6Act, of births, deaths, fetal deaths, adoptions, marriages, or
7dissolution of marriages.
8    (5) "Live birth" means the complete expulsion or extraction
9from its mother of a product of human conception, irrespective
10of the duration of pregnancy, which after such separation
11breathes or shows any other evidence of life such as beating of
12the heart, pulsation of the umbilical cord, or definite
13movement of voluntary muscles, whether or not the umbilical
14cord has been cut or the placenta is attached.
15    (6) "Fetal death" means death prior to the complete
16expulsion or extraction from its mother of a product of human
17conception, irrespective of the duration of pregnancy; the
18death is indicated by the fact that after such separation the
19fetus does not breathe or show any other evidence of life such
20as beating of the heart, pulsation of the umbilical cord, or
21definite movement of voluntary muscles.
22    (7) "Dead body" means a lifeless human body or parts of
23such body or bones thereof from the state of which it may
24reasonably be concluded that death has occurred.
25    (8) "Final disposition" means the burial, cremation, or
26other disposition of a dead human body or fetus or parts

1thereof.
2    (9) "Physician" means a person licensed to practice
3medicine in Illinois or any other State.
4    (10) "Institution" means any establishment, public or
5private, which provides in-patient medical, surgical, or
6diagnostic care or treatment, or nursing, custodial, or
7domiciliary care to 2 or more unrelated individuals, or to
8which persons are committed by law.
9    (11) "Department" means the Department of Public Health of
10the State of Illinois.
11    (12) "Director" means the Director of the Illinois
12Department of Public Health.
13    (13) "Homeless person" means an individual who meets the
14definition of "homeless" under Section 103 of the federal
15McKinney-Vento Homeless Assistance Act (42 U.S.C. 11302) or an
16individual residing in any of the living situations described
17in 42 U.S.C. 11434a(2).

20    Sec. 25.3. Homeless person birth record request.
21    (a) For the purposes of this Section, an individual's
22status as a homeless person may be verified by a human services
23agency, legal services agency, or other similar agency that has
24knowledge of the individual's housing status, including, but
25not limited to:

1        (1) a homeless service agency receiving federal,
2    State, county, or municipal funding to provide those
3    services or otherwise sanctioned by a local continuum of
4    care;
5        (2) an attorney licensed to practice in the State;
6        (3) a public school homeless liaison or school social
7    worker; or
8        (4) a human services provider funded by the State to
9    serve homeless or runaway youth, individuals with mental
10    illness, or individuals with addictions.
11    Individuals who are homeless must not be charged for this
12verification.
13    Anyone who knowingly or purposefully falsifies this
14verification is subject to a penalty of $100.
15    (b) Applicable fees under Section 25 of this Act for a
16search for a birth record or a certified copy of a birth record
17shall be waived for all requests made by a homeless person
18whose status is verified under subsection (a) of this Section.
19    The State Registrar of Vital Records shall establish
20standards and procedures consistent with this Section for
21waiver of such applicable fees.
22    (c) A homeless person shall be provided no more than 4
23birth records annually under this Section.
 
24    Section 99. Effective date. This Act takes effect January
251, 2018.".
