1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by changing Section 2310-650 as follows:
 
7    (20 ILCS 2310/2310-650)
8    Sec. 2310-650. Influenza vaccination program. The
9Department of Public Health may require certified local health
10departments with jurisdiction over areas with more than 500,000
11residents and any facility licensed by the Department to
12implement an influenza vaccination program that ensures that
13the health care personnel employees of the facility are offered
14the opportunity to be vaccinated against seasonal influenza and
15any other novel or pandemic influenza viruses as vaccines
16become available.
17    Nothing in this Section prohibits certified local health
18departments and any facility licensed by the Department from
19implementing more stringent influenza vaccination policies,
20strategies, or programs, including a mandatory health care
21personnel influenza vaccination program that contains measures
22to protect patients from potential exposure to influenza and
23improve health care personnel vaccination rates that are

1consistent with existing law and rules.
2    The Department may adopt rules setting forth the
3requirements of the influenza vaccination program, along with
4exceptions for personnel who may be exempt for medical or
5religious reasons. Medical exemptions shall be consistent with
6current guidelines issued by the Centers for Disease Control
7and Prevention. General philosophical or moral reluctance to
8influenza vaccinations is not a sufficient basis for an
9exemption.

11    Section 99. Effective date. This Act takes effect July 1,
122018.
