AMENDMENT TO HOUSE BILL 2448

2    AMENDMENT NO. ______. Amend House Bill 2448 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Section 12-201 as follows:
 
6    (625 ILCS 5/12-201)  (from Ch. 95 1/2, par. 12-201)
7    Sec. 12-201. When lighted lamps are required.
8    (a) When operated upon any highway in this State, every
9motorcycle shall at all times exhibit at least one lighted
10lamp, showing a white light visible for at least 500 feet in
11the direction the motorcycle is proceeding. However, in lieu of
12such lighted lamp, a motorcycle may be equipped with and use a
13means of modulating the upper beam of the head lamp between
14high and a lower brightness. No such head lamp shall be
15modulated, except to otherwise comply with this Code, during
16times when lighted lamps are required for other motor vehicles.

1    (b) All other motor vehicles shall exhibit at least 2
2lighted head lamps, with at least one on each side of the front
3of the vehicle, which satisfy United States Department of
4Transportation requirements, showing white lights, including
5that emitted by high intensity discharge (HID) lamps, or lights
6of a yellow or amber tint, during the period from sunset to
7sunrise, at times when rain, snow, fog, or other atmospheric
8conditions require the use of windshield wipers, and at any
9other times when, due to insufficient light or unfavorable
10atmospheric conditions, persons and vehicles on the highway are
11not clearly discernible at a distance of 1000 feet. Parking
12lamps may be used in addition to but not in lieu of such head
13lamps. Every motor vehicle, trailer, or semi-trailer shall also
14exhibit at least 2 lighted lamps, commonly known as tail lamps,
15which shall be mounted on the left rear and right rear of the
16vehicle so as to throw a red light visible for at least 500
17feet in the reverse direction, except that a truck tractor or
18road tractor manufactured before January 1, 1968 and all
19motorcycles need be equipped with only one such tail lamp.
20    (b-5) During all other times not specified under subsection
21(b) of this Section, when operated upon any highway in this
22State, every motor vehicle of the first division or motor
23vehicle of the second division weighing no more than 8,000
24pounds shall at all times exhibit: (1) daytime running lights;
25or (2) at least 2 lighted head lamps, with at least one on each
26side of the front of the vehicle, and which satisfy United

1States Department of Transportation requirements, showing
2white lights, including those emitted by high intensity
3discharge (HID) lamps or lights of a yellow or amber tint. A
4violation of this subsection (b-5) is a business offense
5punishable by a fine of $100.
6    For purposes of this subsection (b-5), "daytime running
7lights" means an automotive lighting device on the front of a
8motor vehicle that is automatically switched on when the
9vehicle is moving forward and emits a white, yellow, or amber
10light.
11    (c) Either a tail lamp or a separate lamp shall be so
12constructed and placed as to illuminate with a white light a
13rear registration plate when required and render it clearly
14legible from a distance of 50 feet to the rear. Any tail lamp
15or tail lamps, together with any separate lamp or lamps for
16illuminating a rear registration plate, shall be so wired as to
17be lighted whenever the head lamps or auxiliary driving lamps
18are lighted.
19    (d) A person shall install only head lamps that satisfy
20United States Department of Transportation regulations and
21show white light, including that emitted by HID lamps, or light
22of a yellow or amber tint for use by a motor vehicle.
