SYNOPSIS AS INTRODUCED:
 
605 ILCS 5/6-132

    Amends the Illinois Highway Code. Provides that a township road district may deliver wood chips, mulch, and other products generated in the act of tree maintenance by the district to the residents of the district. Provides that the road district shall provide adequate notice to the resident prior to the delivery of the product. Effective immediately.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Public policy. It is hereby declared that wood
5chips, mulch, and other products generated in the act of tree
6maintenance by a township road district are waste products of
7no value to the district. It is further declared that the
8distribution of the wood chips, mulch, and other products to
9residents of the district is of public benefit, maintenance of
10a healthful environment, and reduces costs by eliminating the
11need to pay for the hauling and disposal of the products. It is
12further recognized that the distribution and delivery of the
13wood chips, mulch, and other products to residents of the
14district is a long-standing tradition in certain parts of this
15State with a minimum fiscal impact. It is further declared that
16this traditional service is salutary, as long as it is provided
17without prejudice or favor to any particular person or
18interest.
 
19    Section 5. The Illinois Highway Code is amended by changing
20Section 6-132 as follows:

22    Sec. 6-132. Recycling; tree maintenance.

1    (a) A road district may organize, administer, or
2participate in one or more recycling programs.
3    (b) Notwithstanding any provision of law to the contrary, a
4road district may deliver wood chips, mulch, and other products
5generated in the act of tree maintenance by the district to the
6residents of the district on a first come, first serve basis.
7The road district shall provide adequate notice to the resident
8prior to the delivery of the product, which shall include the
9weight of the product being delivered.

11    Section 99. Effective date. This Act takes effect upon
12becoming law.
