AMENDMENT TO HOUSE BILL 677

AMENDMENT NO. ______. Amend House Bill 677 by replacing line 4 on page 58 through line 3 on page 59 with the following:

"(a) Nothing in this Act exempts any physician, practice group, hospital, or institution from vicarious liability arising from the employment, agency, or apparent agency of a licensed certified professional midwife that commits an alleged negligent act or omission.

(b) Nothing in this Act exempts any physician or practice group from liability for its own negligent acts or omissions arising out of its failure to supervise or oversee a licensed certified professional midwife, to the extent such a physician or practice group has undertaken to provide such oversight.

(c) Nothing in this Act exempts a hospital or practice group from liability arising out of the credentialing or employment of a licensed certified professional midwife.".
