AMENDMENT TO HOUSE BILL 607

2    AMENDMENT NO. ______. Amend House Bill 607, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 1. Legislative intent. It is hereby declared as
6the intent of this amendatory Act of the 100th General Assembly
7to promote consolidation of redundant layers of government and
8to promote government efficiency.
 
9    Section 5. The Illinois Highway Code is amended by changing
10Sections 6-130 and 6-133 and by adding Section 6-134 as
11follows:
 
12    (605 ILCS 5/6-130)  (from Ch. 121, par. 6-130)
13    Sec. 6-130. Notwithstanding any other provision of this
14Code Act to the contrary, no township road district may
15continue in existence if the roads forming a part of the

1district do not exceed a total of 4 centerline miles in length.
2For purposes of this Section, the roads forming a part of a
3township road district include those roads maintained by the
4district, regardless of whether or not those roads are owned by
5the township. On the first Tuesday in April of 1975, or of any
6subsequent year next succeeding the reduction of a township
7road system to a total mileage of 4 centerline miles or less,
8each such township road district shall, by operation of law, be
9abolished. The roads comprising that district at that time
10shall thereafter be administered by the township board of
11trustees by contracting with the county, a municipality or a
12private contractor. The township board of trustees shall assume
13all taxing authority of a township road district abolished
14under this Section.

17    Sec. 6-133. Abolishing a road district in Cook County. By
18resolution, the board of trustees of any township located in
19Cook County, Illinois, may submit a proposition to abolish the
20road district of that township to the electors of that township
21at a general election or consolidated election in accordance
22with the general election law. The ballot shall be in
23substantially the following form:

1    Shall the Road District of the Township of
2........... be abolished with all the rights,YES
3powers, duties, assets, property, liabilities,
4obligations, and responsibilities being assumed ---------

7    In the event that a majority of the electors voting on such
8proposition are in favor thereof, then the road district shall
9be abolished by operation of law effective on January 1 of the
10calendar year immediately following the calendar year in which
11the proposition was approved by the electors or on the date the
12term of the highway commissioner in office at the time the
13proposition was approved by the electors expires, whichever is
14later.
15    On that date, all the rights, powers, duties, assets,
16property, liabilities, obligations, and responsibilities of
17the road district shall by operation of law vest in and be
18assumed by the township. On that date, the township board of
19trustees shall assume all taxing authority of a road district
20abolished under this Section. On that date, any highway
21commissioner of the abolished road district shall cease to hold
22office, such term having been terminated. Thereafter, the
23township shall exercise all duties and responsibilities of the
24highway commissioner as provided in the Illinois Highway Code.

1the county, a municipality, or a private contractor to
2administer the roads under its jurisdiction. The township board
3of trustees shall assume all taxing authority of a township
4road district abolished under this subsection. For purposes of
5distribution of revenue, the township shall assume the powers,
6duties, and obligations of the road district.

9    Sec. 6-134. Abolishing a road district. By resolution, the
10board of trustees of any township located in a county with less
11than 3,000,000 inhabitants may submit a proposition to abolish
12the road district of that township to the electors of that
13township at a general election or consolidated election in
14accordance with the general election law. The ballot shall be
15in substantially the following form:

9the road district shall by operation of law vest in and be
10assumed by the township. On that date, the township board of
11trustees shall assume all taxing authority of a road district
12abolished under this Section. On that date, any highway
13commissioner of the abolished road district shall cease to hold
14office, such term having been terminated. Thereafter, the
