AMENDMENT TO SENATE BILL 3084

2    AMENDMENT NO. ______. Amend Senate Bill 3084 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Environmental Protection Act is amended by
5changing Section 22.54a as follows:
 
6    (415 ILCS 5/22.54a)
7    (Section scheduled to be repealed on February 1, 2018)
8    Sec. 22.54a. Disposal of asphalt roofing shingles. No owner
9or operator of a sanitary landfill that is located within a
1025-mile radius of both a facility permitted pursuant to Section
1122.38 of this Act and a site where asphalt roofing shingles are
12recycled under a Beneficial Use Determination (BUD) issued by
13the Agency pursuant to Section 22.54 of this Act shall accept
14for disposal loads of whole or processed asphalt roofing
15shingles. Nothing in this Section shall prohibit or restrict a
16sanitary landfill from accepting for disposal asphalt roofing

1shingles that are commingled with municipal waste, excluding
2including, but not limited to, general construction or
3demolition debris.
4    The Agency shall post on its website the name and address
5of each facility permitted pursuant to Section 22.38 of this
6Act and each site at which the recycling of asphalt roofing
7shingles under a BUD is approved.
8    No later than January 31 of each year, each recipient of a
9BUD for asphalt roofing shingles shall submit a report to the
10Agency that contains the following information: (i) the total
11quantity of asphalt roofing shingles received under the BUD
12during the previous calendar year; (ii) the beneficial uses
13during the previous calendar year of shingles received under
14the BUD; (iii) the total quantity of shingles used in each
15beneficial use during the previous calendar year; and (iv) the
16total quantity and disposition of any shingles received but not
17beneficially used under the BUD during the previous calendar
18year. The report must be submitted on a form and in a format
19prescribed by the Agency.
20    This Section is repealed on February 1, 2019 2018.

22    Section 99. Effective date. This Act takes effect upon
23becoming law.".
