AMENDMENT TO SENATE BILL 2186

2    AMENDMENT NO. ______. Amend Senate Bill 2186 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Counties Code is amended by adding Section
55-12021 as follows:
 
6    (55 ILCS 5/5-12021 new)
7    Sec. 5-12021. Special provisions relating to public
8schools.
9    (a) In exercising the powers under this Division with
10respect to public school districts, a county shall act in a
11reasonable manner that neither regulates educational
12activities, such as school curricula, administration, and
13staffing, nor frustrates a school district's statutory duties.
14This subsection (a) is declarative of existing law and does not
15change the substantive operation of this Division.
16    (b) In processing zoning applications from public school

1districts, a county shall make reasonable efforts to streamline
2the zoning application and review process for the school board
3and minimize the administrative burdens involved in the zoning
4review process, including, but not limited to, reducing
5application fees and other costs associated with the project of
6a school board to the greatest extent practicable but in no
7event more than the lowest fees customarily imposed by the
8county for similar applications, limiting the number of times
9the school district must amend its site plans, reducing the
10number of copies of site plans and any other documents required
11to be submitted by the county, and expediting the zoning review
12process for the purpose of rendering a decision on any
13application from a school district within 90 days after a
14completed application is submitted to the county.
 
15    Section 10. The Township Code is amended by changing
16Section 110-70 as follows:
 
17    (60 ILCS 1/110-70)
18    Sec. 110-70. School district affected.
19    (a) In any hearing before a zoning commission or board of
20appeals, any school district within which the property in
21issue, or any part of that property, is located may appear and
22present evidence.
23    (b) In exercising the powers under this Article with

23    Section 15. The Illinois Municipal Code is amended by
24adding Section 11-13-27 as follows:

1    (65 ILCS 5/11-13-27 new)
2    Sec. 11-13-27. Special provisions relating to public
3schools.

7activities, such as school curricula, administration, and
8staffing, nor frustrates a school district's statutory duties.

1    Section 20. The School Code is amended by changing Section
210-22.13a as follows:
 
3    (105 ILCS 5/10-22.13a)
4    Sec. 10-22.13a. Zoning changes, variations, and special
5uses for school district property; zoning compliance. To seek
6zoning changes, variations, or special uses for property held
7or controlled by the school district.
8    A school district is subject to and its school board must
9comply with any valid local government zoning ordinance or
10resolution that applies where the pertinent part of the
11building, structure, or site owned by the school district is
12located. The changes to this Section made by this amendatory
13Act of the 99th General Assembly are declarative of existing
14law and do not change the substantive operation of this
15Section.

17    Section 99. Effective date. This Act takes effect upon
18becoming law.".
