AMENDMENT TO HOUSE BILL 6084

2    AMENDMENT NO. ______. Amend House Bill 6084 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Animal Control Act is amended by changing
5Sections 8 and 13 as follows:
 
6    (510 ILCS 5/8)  (from Ch. 8, par. 358)
7    Sec. 8. Rabies inoculation. Every owner of a dog 4 months
8or more of age shall have each dog inoculated against rabies by
9a licensed veterinarian. Every dog shall have a second rabies
10vaccination within one year of the first. Terms of subsequent
11vaccine administration and duration of immunity must be in
12compliance with USDA licenses of vaccines used. A veterinarian
13immunizing a dog, cat, or ferret against rabies shall provide
14the Administrator of the county in which the dog, cat, or
15ferret resides with a certificate of immunization. Evidence of
16such rabies inoculation shall be entered on a certificate the

1form of which shall be approved by the Board and which shall
2contain the microchip number of the dog, cat, or ferret animal
3if it has one and which shall be signed by the licensed
4veterinarian administering the vaccine. Only one dog, cat, or
5ferret shall be included on each certificate. Veterinarians who
6inoculate a dog shall procure from the County Animal Control in
7the county where their office is located serially numbered
8tags, one to be issued with each inoculation certificate. Only
9one dog shall be included on each certificate. The veterinarian
10immunizing or microchipping an animal shall provide the
11Administrator of the county in which the animal resides with a
12certificate of immunization and microchip number. The Board
13shall cause a rabies inoculation tag to be issued, at a fee
14established by the Board for each dog inoculated against
15rabies.
16    Rabies vaccine for use on animals shall be sold or
17distributed only to and used only by licensed veterinarians.
18Such rabies vaccine shall be licensed by the United States
19Department of Agriculture.
20    If a licensed veterinarian determines in writing that a
21rabies inoculation would compromise an animal's health, then
22the animal shall be exempt from the rabies inoculation shot
23requirement, however, but the owner is must still be
24responsible for the tag fees.
25    If a bite occurs from an exempt animal, the exempt animal
26shall be treated as an unvaccinated animal. If the animal is

1exempt, the animal shall be re-examined by a licensed
2veterinarian on no less than an annual basis and be vaccinated
3against rabies as soon as the animal's health permits.

6    Sec. 13. Dog or other animal bites; observation of animal.
7    (a) Except as otherwise provided in subsections subsection
8(b) and (c) of this Section, when the Administrator or, if the
9Administrator is not a veterinarian, the Deputy Administrator
10receives information that any person has been bitten by an
11animal, the Administrator or, if the Administrator is not a
12veterinarian, the Deputy Administrator, or his or her
13authorized representative, shall have such dog or other animal
14confined under the observation of a licensed veterinarian for a
15period of 10 days. The confinement shall be for a period of not
16less than 10 days from the date the bite occurred and shall
17continue until the animal has been examined and released from
18confinement by a licensed veterinarian. The Administrator or,
19if the Administrator is not a veterinarian, the Deputy
20Administrator Department may permit such confinement to be
21reduced to a period of less than 10 days.
22    (a-5) Any owner, agent, or caretaker of an animal
23documented to have bitten a person shall present the animal to
24a licensed veterinarian within 24 hours. A veterinarian

1shall make a record of report the clinical condition of the
2animal immediately. , with confirmation in writing to the
3Administrator or, if the Administrator is not a veterinarian,
4the Deputy Administrator within 24 hours after the animal is
5presented for examination, giving the owner's name, address,
6the date of confinement, the breed, description, age, and sex
7of the animal, and whether the animal has been spayed or
8neutered, on appropriate forms approved by the Department. The
9Administrator or, if the Administrator is not a veterinarian,
10the Deputy Administrator shall notify the attending physician
11or responsible health agency. At the end of the confinement
12period, the animal shall be examined by a licensed
13veterinarian, inoculated against rabies, if eligible, and
14microchipped, if the dog or cat has not been already, at the
15expense of the owner. The veterinarian shall submit a written
16report listing the owner's name, address, dates of confinement,
17dates of examination, species, breed, description, age, sex,
18and microchip number of the animal to the Administrator or, if
19the Administrator is not a veterinarian, the Deputy
20Administrator advising him or her of the clinical condition and
21the final disposition of the animal on appropriate forms
22approved by the Department. The Administrator shall notify the
23person who has been bitten, and in the case of confirmed rabies
24in the animal, the attending physician or responsible health
25agency advising of the clinical condition of the animal. When
26evidence is presented that the animal was inoculated against

1rabies within the time prescribed by law, it shall be confined
2in a house, or in a manner which will prohibit it from biting
3any person for a period of 10 days, if a licensed veterinarian
4adjudges such confinement satisfactory. The Department may
5permit such confinement to be reduced to a period of less than
610 days. At the end of the confinement period, the animal shall
7be examined by a licensed veterinarian.
8    (a-10) When the Administrator or, if the Administrator is
9not a veterinarian, the Deputy Administrator or his or her
10authorized representative receives information that a person
11has been bitten by an animal and evidence is presented that the
12animal at the time the bite occurred was inoculated against
13rabies within the time prescribed by law, the animal may be
14confined in a house, or in a manner which will prohibit the
15animal from biting a person, if the Administrator, Deputy
16Administrator, or his or her authorized representative
17determines the confinement satisfactory. The confinement shall
18be for a period of not less than 10 days from the date the bite
19occurred and shall continue until the animal has been examined
20and released from confinement by a licensed veterinarian. The
21Administrator or, if the Administrator is not a veterinarian,
22the Deputy Administrator may instruct the owner, agent, or
23caretaker to have the animal examined by a licensed
24veterinarian immediately. The Administrator or, if the
25Administrator is not a veterinarian, the Deputy Administrator
26may permit the confinement to be reduced to a period of less

1than 10 days. At the end of the confinement period, the animal
2shall be examined by a licensed veterinarian and microchipped,
3if the dog or cat is not already, at the expense of the owner.
4The veterinarian shall submit a written report listing the
5owner's name, address, dates of examination, species, breed,
6description, age, sex, and microchip number of the animal to
7the Administrator advising him or her of the clinical condition
8and the final disposition of the animal on appropriate forms
9approved by the Department. The Administrator shall notify the
10person who has been bitten and, in case of confirmed rabies in
11the animal, the attending physician or responsible health
12agency advising of the clinical condition of the animal.
13    (a-15) Any person having knowledge that any person has been
14bitten by an animal shall notify the Administrator or, if the
15Administrator is not a veterinarian, the Deputy Administrator
16within 24 hours promptly.
17    (a-20) It is unlawful for the owner of the animal to
18conceal the whereabouts, euthanize, sell, give away, or
19otherwise dispose of any animal known to have bitten a person,
20until it is examined and released from confinement by the
21Administrator or, if the Administrator is not a veterinarian,
22the Deputy Administrator, or licensed veterinarian or his or
23her authorized representative. It is unlawful for the owner of
24the animal to refuse or fail to immediately comply with the
25reasonable written or printed instructions made by the
26Administrator or, if the Administrator is not a veterinarian,

1the Deputy Administrator, or his or her authorized
2representative. If such instructions cannot be delivered in
3person, they shall be mailed to the owner of the animal by
4regular mail. Any expense incurred in the handling of an animal
5under this Section and Section 12 shall be borne by the owner.
6The owner of a biting animal must also remit to the Department
7of Public Health, for deposit into the Pet Population Control
8Fund, a $25 public safety fine within 30 days after notice.
9    (b) When a person has been bitten by a police dog that is
10currently vaccinated against rabies, the police dog may
11continue to perform its duties for the peace officer or law
12enforcement agency and any period of observation of the police
13dog may be under the supervision of a peace officer. The
14supervision shall consist of the dog being locked in a kennel,
15performing its official duties in a police vehicle, or
16remaining under the constant supervision of its police handler.
17    (c) When a person has been bitten by a search and rescue
18dog that is currently vaccinated against rabies, the search and
19rescue dog may continue to perform its duties for the handler
20or owner or agency and any period of observation of the dog may
21be under the supervision of its handler or owner. The
22supervision shall consist of the dog being locked in a kennel,
23performing its official duties in a vehicle, or remaining under
24the constant supervision of its handler or owner.
25    (d) Any person convicted of violating subsection (a-20) of
26this Section is guilty of a Class A misdemeanor for a first

1violation. A second or subsequent violation is a Class 4
2felony.

4    Section 99. Effective date. This Act takes effect upon
5becoming law.".
