AMENDMENT TO HOUSE BILL 6030

2    AMENDMENT NO. ______. Amend House Bill 6030 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Pension Code is amended by adding
5Section 1-140 as follows:
 
6    (40 ILCS 5/1-140 new)
7    Sec. 1-140. Identification of deceased annuitants. Every
8pension fund or retirement system under this Code, except for a
9pension fund established under Article 3 or 4 of this Code,
10shall develop and implement, by no later than June 30, 2017, a
11process to identify annuitants who are deceased. The process
12shall require the pension fund or retirement system to check
13for any deceased annuitants at least once per month and shall
14include the use of any commonly used methods to identify
15persons who are deceased, which include, but are not limited
16to, the use of a third party entity that specializes in the

1identification of deceased persons, the use of data provided by
2the Social Security Administration, the use of data provided by
3the Department of Public Health's Office of Vital Records, or
4the use of any other method that is commonly used by other
5states to identify deceased persons.
 
6    Section 10. The Vital Records Act is amended by adding
7Section 24.5 as follows:
 
8    (410 ILCS 535/24.5 new)
9    Sec. 24.5. Access to records; pension funds and retirement
10systems. Any information contained in the vital records shall
11be made available at no cost to any pension fund or retirement
12system under the Illinois Pension Code pursuant to Section
131-140 of the Illinois Pension Code.
 
14    Section 90. The State Mandates Act is amended by adding
15Section 8.40 as follows:
 
16    (30 ILCS 805/8.40 new)
17    Sec. 8.40. Exempt mandate. Notwithstanding Sections 6 and 8
18of this Act, no reimbursement by the State is required for the
19implementation of any mandate created by this amendatory Act of
20the 99th General Assembly.
 
21    Section 99. Effective date. This Act takes effect upon
