AMENDMENT TO HOUSE BILL 3932

2    AMENDMENT NO. ______. Amend House Bill 3932 on page 6, line
39, after "undertaken.", by inserting "In all other cases, the
4Public Access Counselor shall forward a copy of the request for
5review to the campus police department within 7 business days
6after receipt and shall specify the records or other documents
7that the campus police department shall furnish to facilitate
8the review. Within 7 business days after receipt of the request
9for review, the campus police department shall provide copies
10of records requested and shall otherwise fully cooperate with
11the Public Access Counselor. If a campus police department
12fails to furnish specified records pursuant to this Section or
13if otherwise necessary, the Attorney General may issue a
14subpoena to any person or campus police department having
15knowledge of or records pertaining to a request for review of a
16denial of access to records under this Section. To the extent
17that records or documents produced by a campus police
18department contain information that is claimed to be exempt

1from disclosure, the public access counselor shall not further
2disclose that information."; and
 
3on page 7, line 5, after "County.", by inserting "If (1) the
4Public Access Counselor determines that the alleged violation
5is unfounded within 180 days after receipt of the request for
6review or (2) the Attorney General chooses to resolve the
7request for review by means other than the issuance of a
8binding opinion within 180 days after receipt of the request
9for review by the Public Access Counselor, then, within 30 days
10after the Public Access Counselor's or Attorney General's
11action, the requester may file suit for injunctive or
12declaratory relief in the circuit court for the county where
13the campus police department is located. If no binding opinion
14is issued within 180 days after receipt of the request for
15review by the Public Access Counselor, then the requester may
16alternatively file suit for injunctive or declaratory relief in
17the circuit court for the county where the campus police
18department is located.".
