SYNOPSIS AS INTRODUCED:
 
30 ILCS 120/17  from Ch. 85, par. 667
30 ILCS 120/18  from Ch. 85, par. 668

    Amends the Agricultural Fair Act. Provides that in counties where a Fair and Exposition Authority participated in 1999, the Fair and Exposition Authority shall transfer all remaining funds to the county fair in such county within 30 days of the effective date of this amendatory Act. Further provides that the terms of the Authority's members shall terminate upon the transfer of all remaining funds and the Authority shall cease to exist. Deletes provisions regarding the Authority's participation in the appropriation from the Fair and Exposition Fund. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Agricultural Fair Act is amended by changing
5Sections 17 and 18 as follows:
 
6    (30 ILCS 120/17)  (from Ch. 85, par. 667)
7    Sec. 17. Fair and expositions. Any county fair eligible to
8participate in appropriations made from the Agricultural
9Premium Fund, except in counties where a Fair and Exposition
10Authority participated in the appropriation in 1999, may elect
11instead in any odd numbered year to participate in the
12appropriation from the Fair and Exposition Fund. The Department
13must be notified of such election by January 1 of the year of
14participation in that fund. Any such election shall be binding
15for 4 calendar years. No county fair shall participate for the
16same calendar year in appropriations under both this Fund and
17the Agricultural Premium Fund.
18    In counties where a Fair and Exposition Authority
19participated in 1999, the Fair and Exposition Authority shall
20transfer all remaining funds to the county fair in such county
21within 30 days of the effective date of this amendatory Act of
22the 99th General Assembly. Upon the transfer of such funds to
23the county fair, the terms of the Authority's members shall

1terminate and the Authority shall cease to exist the Authority
2shall continue to participate in the appropriation from the
3Fair and Exposition Fund. The Fair and Exposition Authority
4shall consist of 7 members appointed by the county board
5chairman with the advice and consent of the county board.

8    Sec. 18. Money shall be paid into the Fair and Exposition
9Fund by the Illinois Racing Board, as provided in Section 28 of
10the Illinois Horse Racing Act of 1975. The General Assembly
11shall from time to time make appropriations payable from such
12fund to the Department for distribution to county fairs and to
13any Fair and Exposition Authority that participated in the
14appropriation in 1999. Such appropriations shall be
15distributed by the Department to county fairs which are
16eligible to participate in appropriations made from the
17Agricultural Premium Fund but which elect instead to
18participate in appropriations made from the Fair and Exposition
19Fund and to Fair and Exposition Authorities that participated
20in the appropriation in 1999. If a county has more than one
21county fair, such fairs shall jointly elect to participate
22either in appropriations made from the Agricultural Premium
23Fund or in appropriations made from the Fair and Exposition
24Fund. All participating county fairs of the same county shall
25participate in the same appropriation. Except as otherwise

1allowed by the Director, a participant, to be eligible to
2expend moneys appropriated from the Fair and Exposition Fund
3for the purchase of new or additional land construction or
4maintenance of buildings, grounds, facilities, infrastructure,
5or any improvement to the grounds must hold the land on which
6such fair or exposition is to be conducted as a fee or under a
7lease of at least 20 years, the terms of which require the
8lessee to have continuous possession of the land during every
9day of the lease period, or must be owned by the fair
10association participating in this disbursement, by an
11agricultural society, or by a fair and exposition authority.

13    Section 99. Effective date. This Act takes effect upon
14becoming law.
