AMENDMENT TO HOUSE BILL 117

2    AMENDMENT NO. ______. Amend House Bill 117 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing Sections
510-20.13, 10-22.33A, 34-18.27, and 34-21.6 and by adding
6Section 34-18.27a as follows:
 
7    (105 ILCS 5/10-20.13)  (from Ch. 122, par. 10-20.13)
8    Sec. 10-20.13. Textbooks for children of parents unable to
9buy them and other fees and tuition.
10    (a) To purchase, at the expense of the district, a
11sufficient number of textbooks for children whose parents are
12unable to buy them, including but not limited to children
13living in households that meet the free lunch or breakfast
14eligibility guidelines established by the federal government
15pursuant to Section 1758 of the federal Richard B. Russell
16National School Lunch Act (42 U.S.C. 1758; 7 C.F.R. 245 et

1seq.), subject to verification as set forth in subsection (c)
2of this Section. Such textbooks shall be loaned only, and the
3directors shall require the teacher to see that they are
4properly cared for and returned at the end of each term of
5school.
6    (b) To waive all fees and tuition assessed by the district
7on children whose parents are unable to afford them, including
8but not limited to children living in households that meet the
9free lunch or breakfast eligibility guidelines established by
10the federal government pursuant to Section 1758 of the federal
11Richard B. Russell National School Lunch Act (42 U.S.C. 1758; 7
12C.F.R. 245 et seq.), subject to verification as set forth in
13subsection (c) of this Section. The school board shall adopt
14written policies and procedures for such waiver of fees and
15tuition in accordance with regulations promulgated by the State
16Board of Education.
17    (c) Any school board that participates in a federally
18funded, school-based child nutrition program and uses a
19student's application for, eligibility for, or participation
20in the federally funded, school-based child nutrition program
21(42 U.S.C. 1758; 7 C.F.R. 245 et seq.) as the basis for waiving
22fees and tuition assessed by the school district must follow
23the verification requirements of the federally funded,
24school-based child nutrition program (42 U.S.C. 1758; 7 C.F.R.
25245.6a).
26    A school board that establishes a process for the

1determination of eligibility for waiver of fees and tuition
2assessed by the school district that is completely independent
3of a student's application for, eligibility for, or
4participation in a federally funded, school-based child
5nutrition program may provide for fee and tuition waiver
6verification no more often than every 60 calendar days.
7Information obtained during the independent, fee and tuition
8waiver verification process indicating that the student does
9not meet free lunch or breakfast eligibility guidelines may be
10used to deny the waiver of the student's fees and tuition,
11provided that any information obtained through this
12independent process for determining or verifying eligibility
13for fee and tuition waivers shall not be used to determine or
14verify eligibility for any federally funded, school-based
15child nutrition program.

18    Sec. 10-22.33A. Summer school. During that period of the
19calendar year not embraced within the regular school term to
20provide and conduct courses in subject matters normally
21embraced in the program of the schools during the regular
22school term, to fix and collect a charge for attendance at such
23courses in an amount not to exceed the per capita cost of the
24operation thereof, except that the board must may waive all or
25part of such charges if it determines that the family of an

1individual pupil is indigent or that the educational needs of
2the pupil require his attendance at such courses, and to give
3regular school credit for satisfactory completion by the
4student of such courses as may be approved for credit by the
5State Board of Education.

7    (105 ILCS 5/34-18.27)
8    Sec. 34-18.27. Summer kindergarten. The board may
9establish, maintain, and operate, in connection with the
10kindergarten program of the school district, a summer
11kindergarten program that begins 2 months before the beginning
12of the regular school year and a summer kindergarten program
13for grade one readiness for those pupils making unsatisfactory
14progress during the regular kindergarten session that will
15continue for 2 months after the regular school year. The summer
16kindergarten program may be held within the school district or,
17pursuant to a contract that must be approved by the State Board
18of Education, may be operated by 2 or more adjacent school
19districts or by a public or private university or college.
20Transportation for students attending the summer kindergarten
21program shall be the responsibility of the school district. The
22expense of establishing, maintaining, and operating the summer
23kindergarten program may be paid from funds contributed or
24otherwise made available to the school district for that
25purpose by federal or State appropriation. The provisions of

1this Section are subject to Section 34-21.6 of this Code.
