AMENDMENT TO SENATE BILL 3411

2    AMENDMENT NO. ______. Amend Senate Bill 3411, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Department of Natural Resources
6(Conservation) Law of the Civil Administrative Code of Illinois
7is amended by adding Section 805-537 as follows:
 
8    (20 ILCS 805/805-537 new)
9    Sec. 805-537. Conservation Police Officer quotas
10prohibited. The Department may not require a Conservation
11Police Officer to issue a specific number of citations within a
12designated period of time. This prohibition shall not affect
13the conditions of any federal or State grants or funds awarded
14to the Department and used to fund traffic enforcement
15programs.
16    The Department may not, for purposes of evaluating a

1Conservation Police Officer's job performance, compare the
2number of citations issued by the Conservation Police Officer
3to the number of citations issued by any other Conservation
4Police Officer who has similar job duties. Nothing in this
5Section shall prohibit the Department from evaluating a
6Conservation Police Officer based on the Conservation Police
7Officer's points of contact. For the purposes of this Section,
8"points of contact" means any quantifiable contact made in the
9furtherance of the Conservation Police Officer's duties
10including, but not limited to, the number of traffic stops
11completed, arrests, written warnings, and crime prevention
12measures. Points of contact shall not include either the
13issuance of citations or the number of citations issued by a
14Conservation Police Officer.
 
15    Section 10. The State Police Act is amended by adding
16Section 24 as follows:
 
17    (20 ILCS 2610/24 new)
18    Sec. 24. State Police quotas prohibited. The Department may
19not require a Department of State Police officer to issue a
20specific number of citations within a designated period of
21time. This prohibition shall not affect the conditions of any
22federal or State grants or funds awarded to the Department and
23used to fund traffic enforcement programs.

1Department of State Police officer's job performance, compare
2the number of citations issued by the Department of State
3Police officer to the number of citations issued by any other
4Department of State Police officer who has similar job duties.
5Nothing in this Section shall prohibit the Department from
6evaluating a Department of State Police officer based on the
7Department of State Police officer's points of contact. For the
8purposes of this Section, "points of contact" means any
9quantifiable contact made in the furtherance of the Department
10of State Police officer's duties, including, but not limited
11to, the number of traffic stops completed, arrests, written
12warnings, and crime prevention measures. Points of contact
13shall not include either the issuance of citations or the
14number of citations issued by a Department of State Police
15officer.
 
16    Section 15. The Counties Code is amended by adding Section
175-1136 as follows:
 
18    (55 ILCS 5/5-1136 new)
19    Sec. 5-1136. Quotas prohibited. A county may not require a
20law enforcement officer to issue a specific number of citations
21within a designated period of time. This prohibition shall not
22affect the conditions of any federal or State grants or funds
23awarded to the county and used to fund traffic enforcement
24programs.

1    A county may not, for purposes of evaluating a law
2enforcement officer's job performance, compare the number of
3citations issued by the law enforcement officer to the number
4of citations issued by any other law enforcement officer who
5has similar job duties. Nothing in this Section shall prohibit
6a county from evaluating a law enforcement officer based on the
7law enforcement officer's points of contact.
8    For the purposes of this Section:
9        (1) "Points of contact" means any quantifiable contact
10    made in the furtherance of the law enforcement officer's
11    duties, including, but not limited to, the number of
12    traffic stops completed, arrests, written warnings, and
13    crime prevention measures. Points of contact shall not
14    include either the issuance of citations or the number of
15    citations issued by a law enforcement officer.
16        (2) "Law enforcement officer" includes any sheriff,
17    undersheriff, deputy sheriff, county police officer, or
18    other person employed by the county as a peace officer.
19    A home rule unit may not establish requirements for or
20assess the performance of law enforcement officers in a manner
21inconsistent with this Section. This Section is a limitation
22under subsection (i) of Section 6 of Article VII of the
23Illinois Constitution on the concurrent exercise by home rule
24units of powers and functions exercised by the State.
 
25    Section 20. The Illinois Municipal Code is amended by

1adding Section 11-1-12 as follows:
 
2    (65 ILCS 5/11-1-12 new)
3    Sec. 11-1-12. Quotas prohibited. A municipality may not
4require a police officer to issue a specific number of
5citations within a designated period of time. This prohibition
6shall not affect the conditions of any federal or State grants
7or funds awarded to the municipality and used to fund traffic
8enforcement programs.
9    A municipality may not, for purposes of evaluating a police
10officer's job performance, compare the number of citations
11issued by the police officer to the number of citations issued
12by any other police officer who has similar job duties. Nothing
13in this Section shall prohibit a municipality from evaluating a
14police officer based on the police officer's points of contact.
15For the purposes of this Section, "points of contact" means any
16quantifiable contact made in the furtherance of the police
17officer's duties including, but not limited to, the number of
18traffic stops completed, arrests, written warnings, and crime
19prevention measures. Points of contact shall not include either
20the issuance of citations or the number of citations issued by
21a police officer.
22    This Section shall not apply to a municipality subject to
23Section 10-1-18.1 of this Code with its own independent
24inspector general and law enforcement review authority.
25    A home rule municipality may not establish requirements for

1or assess the performance of police officers in a manner
2inconsistent with this Section. This Section is a limitation
3under subsection (i) of Section 6 of Article VII of the
