AMENDMENT TO SENATE BILL 3342

2    AMENDMENT NO. ______. Amend Senate Bill 3342, AS AMENDED,
3with reference to page and line numbers of Senate Amendment No.
41, on page 3, immediately below line 15 by inserting the
5following:
6        "A district located wholly within McHenry County may
7    not levy a rate that exceeds 0.1% without first submitting
8    the question to the voters of the district. The question
9    shall be submitted in accordance with the Election Code.
10    The governing body of the district shall certify the
11    question to the proper election authorities who shall
12    submit the question to the electors of the district in
13    substantially the following form:
14            Shall (name of district) be permitted to levy a
15        rate of (insert rate) beginning with levy year (year)
16        for the general purposes of the district, including the
17        acquisition, development, operation and maintenance of
18        real property, which may be in excess of current

1        requirements and allowed to accumulate from year to
2        year, and for any purposes specified by the district?
3        The votes must be recorded as "Yes" or "No".
4        If a majority of voters voting on the increase approve
5    its adoption, the increase shall take effect beginning with
6    the levy year specified in the question.
7        If the district is seeking to levy a rate that exceeds
8    its limiting rate under the Property Tax Extension
9    Limitation Law, then the district shall submit the question
10    to the voters of the district in accordance with Section
11    18-190 of the Property Tax Code in lieu of the requirements
12    set forth in this paragraph (4).".
