AMENDMENT TO SENATE BILL 1595

2    AMENDMENT NO. ______. Amend Senate Bill 1595 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Construction Law is amended by
5changing Section 5-40 as follows:
 
6    (105 ILCS 230/5-40)
7    Sec. 5-40. Supervision of school construction projects;
8green projects. The Capital Development Board shall exercise
9general supervision over school construction projects financed
10pursuant to this Article. School districts, however, must be
11allowed to choose the architect and engineer for their school
12construction projects, and no project may be disapproved by the
13State Board of Education or the Capital Development Board
14solely due to a school district's selection of an architect or
15engineer.
16    With respect to those school construction projects for

1which a school district first applies for a grant on or after
2July 1, 2007, the school construction project must receive
3certification from the United States Green Building Council's
4Leadership in Energy and Environmental Design Green Building
5Rating System or the Green Building Initiative's Green Globes
6Green Building Rating System or must meet green building
7standards of the Capital Development Board and its Green
8Building Advisory Committee. With respect to those school
9construction projects for which a school district applies for a
10grant on or after July 1, 2009, the school construction project
11must receive silver certification from the United States Green
12Building Council's Leadership in Energy and Environmental
13Design Green Building Rating System unless all of the following
14are met:
15        (1) the application submitted can be categorized as a
16    capital need prioritized under item (1) of Section 5-30 of
17    this Law;
18        (2) the renovation or replacement school construction
19    project is less than 40% replacement cost, or the project
20    has been granted a waiver by the Capital Development Board
21    in consultation with the State Board of Education in
22    accordance with rules promulgated pursuant to this Law;
23        (3) the school construction project is located in a
24    county that borders the Mississippi River with a population
25    of more than 33,000 and less than 34,000, according to the
26    2010 decennial census;

1        (4) the school district for which the school
2    construction grant will be issued has no more than 1,100
3    students, with the relevant school facility housing no more
4    than 700 students;
5        (5) the facilities for which the school construction
6    grant will be used have been condemned as of July 23, 2012;
7    and
8        (6) the application for the school construction grant
9    has been approved prior to the effective date of this
10    amendatory Act of the 98th General Assembly.

12    Section 99. Effective date. This Act takes effect upon
13becoming law.".
