AMENDMENT TO SENATE BILL 1572

2    AMENDMENT NO. ______. Amend Senate Bill 1572 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by adding Sections
52-3.157, 34-18.48, and 34-18.49 as follows:
 
6    (105 ILCS 5/2-3.157 new)
7    Sec. 2-3.157. City of Chicago School District 299 reports.
8    (a) The State Board of Education shall prepare a report on
9the practices and trends in the operations of City of Chicago
10School District 299 with respect to the impact of charter
11school enrollment on the operation of the school district. The
12State Board of Education shall gather data regarding student
13enrollment and placement policies, disciplinary procedures,
14programs for special education, English Language Learners
15(ELL), and any other relevant student needs for each public
16school in the district, including charter schools. The report

1shall specifically identify any polices that give schools
2latitude to discourage attendance of students or that would
3create barriers for any students to attend. In addition, the
4State Board of Education shall gather data on mobility,
5attendance rates, graduation rates, and incoming and outgoing
6transfers at each grade level for each public school in the
7district, including charter schools. The report shall identify
8the extent to which transfers from charter schools to other
9schools occur before or after any deadlines related to funding.
10The report shall identify the extent to which charter schools
11accept transfers into the school at each grade level, as
12compared to transfers out. The report shall compare charter
13school enrollment by race, disability, income, and ELL status
14to other charter and traditional public schools in the
15district. The report shall compare the instructional programs,
16methods, and instructional materials of each public school in
17the district, including charter schools.
18    The district shall comply with all requests for information
19made by the State Board of Education necessary for the State
20Board of Education to prepare this report.
21    The State Board of Education shall file copies of this
22report as provided in Section 3.1 of the General Assembly
23Organization Act.
24    (b) The State Board of Education shall prepare a report on
25the impact of school actions, such as school closures and
26school turnarounds, on the practices and trends in the

1operation of City of Chicago School District 299. The report
2shall include all of the following:
3        (1) A community analysis that includes current and
4    projected demographics, land usage, transportation plans,
5    residential housing and commercial development, private
6    school plans for water and sewage expansion or
7    redevelopment, and institutions of higher education.
8        (2) A description of the district's guiding
9    educational principles and standards.
10        (3) A description of the types of instructional
11    programs or services delivered at each school.
12        (4) The enrollment capacity of each school and its rate
13    of utilization.
14        (5) A report on the assessment of individual building
15    and site conditions.
16        (6) A data table with historical and projected
17    enrollment data by school and by grade.
18        (7) An analysis of facility needs and requirements of
19    the district.
20        (8) Identification of potential sources of funding for
21    the implementation of the district's Educational Facility
22    Master Plan.
23    The report shall also include identification of all
24external firms and agencies contracted to aid the district in
25performing school actions and transitions. The firms and
26agencies shall disclose financial interests, fees paid by the

1district, and any and all relationships it holds with any
2member of the school board or city council.
3    The district shall comply with all requests for information
4made by the State Board of Education necessary for the State
5Board of Education to prepare this report.
6    The State Board of Education shall file copies of this
7report as provided in Section 3.1 of the General Assembly
8Organization Act.
9    (c) The State Board of Education shall prepare a report on
10the impact of standardized testing on the operations and
11practices of City of Chicago School District 299. The report
12shall include the amount of time educators prepare for tests,
13administer tests, and analyze results. The report shall also
14include the amount of money spent on procuring standardized
15tests. The report shall include the number of tests given to
16students and the frequency of tests at each grade level and at
17each school in the district. The report shall include financial
18disclosures by the company or firm that owns the tests and
19preparation materials that include any prior relationships
20with the district or agents of the district. The report shall
21compare the frequency of tests given to students in schools
22that have charters approved by the district and other district
23schools.
24    The report shall be completed and made available to the
25public each year on or before July 31. If the district does not
26make available all information requested by the State Board of

1Education necessary for the State Board of Education to prepare
2this report, the State Board of Education, in an administrative
3proceeding, shall impose a civil penalty on the district equal
4to $2,900 for every day the information is unavailable after
5the July 31 report date. The Attorney General may bring an
6action in circuit court to enforce the collection of any
7monetary penalty imposed.
8    (d) The State Board of Education may adopt any rules
9necessary to carry out its responsibilities under this Section.
 
10    (105 ILCS 5/34-18.48 new)
11    Sec. 34-18.48. School property; sale of unusable property;
12real estate transaction standards.
13    (a) When school properties are deemed unusable by the
14district and are slated for sale, the district must sell the
15properties at market rate.
16    (b) The State Board of Education shall create standards for
17district real estate transactions and shall approve all real
18estate arrangements.

20    Sec. 34-18.49. Statement of revenues and in-kind services.
21The district shall create a statement of revenues and in-kind
22services it receives. The statement shall also include the
23value of any in-kind services, payments to third parties, or
24other supports from the district to its charter schools. Any

1support for marketing or recruiting activities, sharing of
2lists of students, or other services must be reported as well.
3The statement must be made available to the public.".
