AMENDMENT TO HOUSE BILL 5633

2    AMENDMENT NO. ______. Amend House Bill 5633, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
 
5    "Section 5. The Public Utilities Act is amended by changing
6the heading of Article XX and Sections 19-130, 20-101, 20-102,
7and 20-110 as follows:
 
8    (220 ILCS 5/19-130)
9    Sec. 19-130. Commission study and report. The Commission's
10Office of Retail Market Development shall prepare an annual
11report regarding the development of competitive retail natural
12gas markets in Illinois. The Office shall monitor existing
13competitive conditions in Illinois, identify barriers to
14retail competition for all customer classes, and actively
15explore and propose to the Commission and to the General
16Assembly solutions to overcome identified barriers. Solutions

1proposed by the Office to promote retail competition must also
2promote safe, reliable, and affordable natural gas service.
3    On or before October 1 of each year, beginning in 2015, the
4Director shall submit a report to the Commission, the General
5Assembly, and the Governor, that includes The report shall be
6approved by the Commission and be filed by July 1 of each odd
7year with the Joint Committee on Legislative Support Services
8of the General Assembly and the Governor and shall be publicly
9available. The report shall include, at a minimum, the
10following information:
11        (1) an analysis of the status and development of the
12    retail natural gas market in the State of Illinois; and
13        (2) a discussion of any identified barriers to the
14    development of competitive retail natural gas markets in
15    Illinois and proposed solutions to overcome identified
16    barriers; and
17        (3) any other information the Office Commission
18    considers significant in assessing the development of
19    natural gas markets in the State of Illinois.
20    To aid in preparation of its annual report, as well in its
21assessment of barriers to the development of competitive retail
22natural gas markets and proposed solutions to overcome those
23barriers, the Commission's Office of Retail Market Development
24shall gather input from all interested parties as well as from
25other bureaus within the Commission.

5    Sec. 20-101. This Article may be cited as the Consumer
6Retail Electric Competition Act of 2006.

9    Sec. 20-102. Findings and intent.
10    (a) Competitive A competitive wholesale electricity and
11natural gas markets market alone will not deliver the full
12benefits of competition to Illinois consumers. For Illinois
13consumers to receive products, prices, and terms tailored to
14meet their needs, a competitive wholesale markets electricity
15market must be closely linked to a competitive retail electric
16and competitive retail natural gas markets market.
17    (b) To date, as a result of the Electric Service Customer
18Choice and Rate Relief Law of 1997, thousands of large Illinois
19commercial and industrial consumers have experienced the
20benefits of a competitive retail electricity market.
21Alternative electric retail suppliers actively compete to
22supply electricity to large Illinois commercial and industrial
23consumers with attractive prices, terms, and conditions.

1    (c) A competitive retail electric market does not yet exist
2for residential and small commercial consumers. As a result,
3millions of residential and small commercial consumers in
4Illinois are faced with escalating heating and power bills and
5are unable to shop for alternatives to the rates demanded by
6the State's incumbent electric utilities.
7    (d) The General Assembly reiterates its findings from the
8Electric Service Customer Choice and Rate Relief Law of 1997
9that the Illinois Commerce Commission should promote the
10development of an effectively competitive retail electricity
11market that operates efficiently and benefits all Illinois
12consumers.
13    (e) The General Assembly also finds that consumers of
14retail natural gas would benefit from market opening solutions
15and competitive choices.

18    Sec. 20-110. Office of Retail Market Development. Within 90
19days after February 2, 2007 (the effective date of Public Act
2094-1095) this amendatory Act of the 94th General Assembly,
21subject to appropriation, the Commission shall establish an
22Office of Retail Market Development and employ on its staff a
23Director of Retail Market Development to oversee the Office.
24The Director shall have authority to employ or otherwise retain
25at least 2 professionals dedicated to the task of actively

1seeking out ways to promote retail competition in Illinois to
2benefit all Illinois consumers.
3    The Office shall actively seek input from all interested
4parties and shall develop a thorough understanding and critical
5analyses of the tools and techniques used to promote retail
6competition in other states.
7    The Office shall monitor existing competitive conditions
8in Illinois, identify barriers to retail competition for all
9customer classes, and actively explore and propose to the
10Commission and to the General Assembly solutions to overcome
11identified barriers. The Director may include municipal
12aggregation of customers and creating and designing customer
13choice programs as tools for retail market development.
14Solutions proposed by the Office to promote retail competition
15must also promote safe, reliable, and affordable electric and
16natural gas service.
17    On or before June 30 of each year, the Director shall
18submit a report to the Commission, the General Assembly, and
19the Governor, that details specific accomplishments achieved
20by the Office in the prior 12 months in promoting retail
21electric and retail natural gas competition and that suggests
22administrative and legislative action necessary to promote
23further improvements in retail electric competition.
