AMENDMENT TO HOUSE BILL 5079

2    AMENDMENT NO. ______. Amend House Bill 5079 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Wildlife Code is amended by changing
5Section 3.3 as follows:
 
6    (520 ILCS 5/3.3)  (from Ch. 61, par. 3.3)
7    Sec. 3.3. Trapping license required. Before any person
8shall trap any of the mammals protected by this Act, for which
9an open trapping season has been established, he shall first
10procure a trapping license from the Department to do so. No
11traps shall be placed in the field, set or unset, prior to the
12opening day of the trapping season.
13    Traps used in the taking of such mammals shall be marked or
14tagged with metal tags or inscribed in lettering giving the
15name and address of the owner, and absence of such mark or tag
16shall be prima facie evidence that such trap or traps are

1illegally used and the trap or traps shall be confiscated and
2disposed of as directed by the Department.
3    Before any person 16 years of age or older shall trap,
4attempt to trap, or sell the green hides of any mammal of the
5species defined as fur-bearing mammals by Section 2.2 for which
6an open season is established under this Act, he shall first
7have procured a State Habitat Stamp.
8    Before a trapping license shall be issued to any person
9under the age of sixteen years, such person shall obtain the
10written consent of his father, mother or legally constituted
11guardian to obtain such license.
12    Beginning January 1, 2015 1985, no trapping license shall
13be issued to any person born on or after January 1, 2015 or who
14has not previously held a valid trapping license issued by this
15State or another state within the 3 years immediately preceding
16the application under 18 years of age unless he or she presents
17to the authorized issuer of the person authorized to issue such
18license either evidence that he or she has held a trapping
19license issued by the State of Illinois or another state in a
20prior year, or a certificate of competency provided for in this
21Section.
22    The Department of Natural Resources shall authorize
23personnel of the Department, or volunteer instructors, found by
24the Department to be competent, to provide instruction in
25courses on trapping techniques and ethical trapping behavior as
26needed throughout the State, which courses shall be at least 8

1hours in length. Persons so authorized shall provide
2instruction in such courses to individuals at no charge, and
3shall issue to individuals successfully completing such
4courses certificates of competency in basic trapping
5techniques. The Department shall cooperate in establishing
6such courses with any reputable association or organization
7which has as one of its objectives the promotion of the ethical
8use of legal fur harvesting devices and techniques. The
9Department shall furnish information on the requirements of the
10trapper education program to be distributed free of charge to
11applicants for trapping licenses by the persons appointed and
12authorized to issue licenses.
13    The owners residing on, or bona fide tenants of farm lands,
14and their children actually residing on such lands, shall have
15the right to trap mammals protected by this Act, for which an
16open trapping season has been established, upon such lands,
17without procuring licenses, provided that such mammals are
18taken during the periods of time and with such devices as are
19permitted by this Act.
