AMENDMENT TO SENATE RESOLUTION 25

2    AMENDMENT NO. ___. Amend Senate Resolution 25 on page 1, by
3replacing lines 2 through 4 with the following:
 
4    "BE IT RESOLVED, BY THE SENATE OF THE NINETY-SEVENTH
5GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that the Rules of
6the Senate of the 97th General Assembly are amended by changing
7Rule 10-2 as follows:
 
 
8    (Senate Rule 10-2)
9    10-2. Appointment Messages.
10    (a) Every nomination subject to the advice and consent of
11the Senate shall be submitted to the Senate by an Appointment
12Message from the appointing officer or appointing authority in
13accordance with this Rule, using the Appointment Message form
14provided in this Rule, containing all of the required
15information, and accompanied by a cover letter signed by the

1appointing officer or on behalf of the appointing authority.
 
2    (b) All Appointment Messages shall be drafted by the
3Legislative Reference Bureau, according to the form provided in
4this Rule.
 
5    (c) Appointment Messages submitted shall be assigned a
6sequential number by the Secretary of the Senate, indicating
7the order in which they were received and read into the Senate
8record by the Secretary of the Senate at the direction of the
9Senate President. An Appointment Message is received by the
10Senate when it is read into the Senate record and assigned a
11sequential number.
 
12    (d) An Appointment Message that does not conform to the
13requirements of this Rule shall, at the direction of the Senate
14President, (i) be ruled non-compliant and of no legal effect
15and (ii) returned by the Secretary of the Senate to the
16appointing officer or authority that filed it.
 
17    (e) The appointing officer or authority may file in
18accordance with this Rule an Appointment Message that
19supersedes a previously filed Appointment Message. A
20superseding Appointment Message shall identify by sequential
21number the Appointment Message that it supersedes. The filing
22of a superseding Appointment Message shall automatically table

1the Appointment Message that it supersedes, and that superseded
2Appointment Message shall have no further legal effect.
 
3    (f) Nothing in this Rule shall be construed to prohibit an
4appointing officer or authority from withdrawing in writing an
5Appointment Message that was previously submitted to or
6received by the Senate. An Appointment Message that has been
7withdrawn shall have no further legal effect.
 
8    (g) An Appointment Message (i) shall be a
9committee-sponsored legislative measure that is unamendable
10and (ii) shall be controlled by the Chairperson of the
11Executive Appointments Committee, who for purposes of these
12Senate Rules shall be deemed the principal sponsor. In the
13absence of the Chairperson, the Vice-Chairperson of the
14Executive Appointments Committee shall be deemed the principal
15sponsor. Messages may not have individual cosponsors.
 
16    (h) Any Appointment Message pending when the Senate
17adjourns sine die (i) shall carry over into the next General
18Assembly and (ii) shall be considered to have been received by
19the Senate when originally read into the Senate record as
20provided for in subsection (c) of this Rule. An Appointment
21Message carrying over into the next General Assembly shall
22retain the sequential number assigned when originally read into
23the Senate record as provided for in subsection (c) of this

1Rule.
 
2    (i) Notwithstanding the requirements contained in this
3Rule, any Appointment Message submitted to the 96th General
4Assembly and not acted upon by the 96th General Assembly is
5deemed to be carried over to the 97th General Assembly. The
6Senate may take action on any Appointment Message carried over
7from the Senate of the 96th General Assembly. Nothing in this
8Rule shall be construed to prohibit an appointing officer or
9authority from withdrawing in writing an Appointment Message
10that was previously submitted to or received by the Senate of
11the 96th General Assembly and carried over into the Senate of
12the 97th General Assembly. An Appointment Message carried over
13from the Senate of the 96th General Assembly that has been
14withdrawn in the Senate of the 97th General Assembly shall have
15no further legal effect.

14legislative measure which is unamendable, and shall be
15controlled by the Chairperson of the Executive Appointments
16Committee, who for purposes of these Senate Rules shall be
17deemed the principal sponsor or, in the absence of the
18Chairperson, the Vice-Chairperson of the Executive
19Appointments Committee shall be deemed the principal sponsor.
20Messages may not have individual cosponsors.
 
21    (g) Any Appointment Message pending when the Senate
22adjourns sine die shall automatically be tabled, and that

1officer or authority shall file a new Appointment message in
2accordance with the Senate Rules of the new General Assembly if
3they wish for the nomination to be considered by the Senate for
