AMENDMENT TO SENATE BILL 3780

AMENDMENT NO. ______. Amend Senate Bill 3780 on page 7, line 18, after "abuse" by inserting the following:

", the recipient was an in-patient or resident of a public or private hospital or mental health facility when an alleged sexual assault or sexual abuse occurred,"; and

on page 8, line 5, after "cause.", by inserting the following: "Medical treatment and diagnosis shall be redacted from any records produced unless the court has found that the recipient has been informed as adequately and as effectively as possible of the request for such records. Non-medical treatment and diagnosis, such as physical characteristics, are not required to be redacted."; and

on page 8, line 10, after "examination", by inserting the following: "For purposes of this paragraph (13), the term "sexual assault" shall have the same meaning that the term "criminal sexual assault" is given in Section 11-1.20 in the Criminal Code of 1961 and the term "sexual abuse" shall have the same meaning that the term "criminal sexual abuse" is given in Section 11-1.50 in the Criminal Code of 1961.".
