SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Medicaid Budget and Impact Note Act. Requires every bill that amends the Illinois Public Aid Code, affects eligibility for or enrollment in Medicaid, or has a financial impact on the operation of the Department of Healthcare and Family Services to have prepared for it, prior to second reading in each chamber, a brief explanatory statement or note that includes a reliable estimate of the expected impact of the bill on the annual budget of the Department of Healthcare and Family Services and the State of Illinois, as well as the projected costs and benefits associated with the implementation of each provision in the bill. Authorizes any member of the General Assembly to request one of these notes. Requires the Director of Healthcare and Family Services, or his or her designee, to respond to requests for notes.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Medicaid Budget and Impact Note Act.
 
6    Section 5. Medicaid budget and impact note required. Every
7bill that amends the Illinois Public Aid Code, affects
8eligibility for or enrollment in Medicaid, or has a financial
9impact on the operation of the Department of Healthcare and
10Family Services shall have prepared for it, prior to second
11reading in each chamber, a brief explanatory statement or note
12that includes a reliable estimate of the expected impact of the
13bill on the annual budget of the Department of Healthcare and
14Family Services and the State of Illinois, as well as an
15accurate projection of the costs and benefits associated with
16the implementation of each provision in the bill.
 
17    Section 10. Request for and delivery of note. Upon the
18request of any member of the General Assembly, the Director of
19the Department of Healthcare and Family Services, or any person
20within the Department whom the Director may designate, shall
21prepare a written statement setting forth the information
22specified in Section 5.

1    The statement prepared by the Director of Healthcare and
2Family Services shall be designated a Medicaid Budget and
3Impact Note and shall be furnished to the member who made the
4request within 10 calendar days thereafter, except that
5whenever, because of the complexity of the bill, additional
6time is required for the preparation of the note, the
7Department of Healthcare and Family Services may so notify the
8requester and ask for an extension of time not to exceed 5
9additional days within which the note is to be furnished. No
10extension shall extend beyond May 15 following the date of the
11request.
 
12    Section 15. Contents of note. The note shall be factual in
13nature, as brief and concise as may be, and shall provide as
14reliable an estimate, in terms of dollar and programmatic
15impact, as is possible under the circumstances. The note shall
16include both the immediate effect, and if determinable or
17reasonably foreseeable, the long-range effect of the measure.
18The note shall also indicate the dollar amounts that will be
19received, from the federal government and other sources, and
20the amounts that are expected to be expended by the State.
21    If, after careful investigation, it is determined that no
22dollar estimate is possible, the note shall contain a statement
23to that effect, setting forth the reasons why no such estimate
24can be given. A brief summary or work sheet of computations and
25all assumptions used in arriving at the Medicaid Budget and

1Impact Note figures shall be supplied.
2    No comment or opinion shall be included in the note with
3regard to the merits of the measure for which the note is
4prepared; however, technical or mechanical defects may be
5noted.
6    The work sheet shall include, insofar as practicable, a
7breakdown of the costs and benefits upon which the note is
8based. The note shall also include such other information as is
9required by the rules and regulations that may be promulgated
10by each house of the General Assembly with respect to the
11preparation of such notes.
12    The note shall be prepared in quintuplicate and the
13original of both the note and the work sheet shall be signed by
14the Director of Healthcare and Family Services or such person
15as the Director may designate.
 
16    Section 20. Appearance before legislative committee. The
17fact that a Medicaid Budget and Impact Note is prepared for any
18bill shall not preclude or restrict the appearance before any
19committee of the General Assembly, of any official or
20authorized employee of any State board, commission,
21department, agency, or other entity who desires to be heard in
22support of, or in opposition to, the measure.
 
23    Section 25. Applicability to amendments. Whenever any
24measure is amended on the floor of either house in such manner

1as to bring it within the description of bills set forth in
2Section 5 above, a majority of such house may propose that no
3action shall be taken upon the amendment until the Director of
4Healthcare and Family Services presents a note that complies
5with the requirements of this Act.
 
6    Section 30. Confidentiality. The subject matter of bills
7submitted to the Director of Healthcare and Family Services
8shall be kept in strict confidence, and no information relating
9thereto or relating to the budget or impact thereof shall be
10divulged by an official or employee of the Department of
11Healthcare and Family Services, except to the requester, or his
12or her designee, prior to the bill's introduction in the
13General Assembly.
