Creates the Medicaid Budget and Impact Note Act. Requires every bill that amends the Illinois Public Aid Code, affects eligibility for or enrollment in Medicaid, or has a financial impact on the operation of the Department of Healthcare and Family Services to have prepared
for it, prior to second reading in each chamber, a brief explanatory
statement or note that includes a reliable estimate of the expected impact of the bill on the
annual budget of the Department of Healthcare and Family Services and the State of Illinois, as well as the projected costs and benefits associated with the implementation of each provision in the bill. Authorizes any member of the General Assembly to request one of these notes. Requires the Director of Healthcare and Family Services, or his or her designee, to respond to requests for notes.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 1. Short title. This Act may be cited as the | 5 | | Medicaid Budget and Impact Note Act. | 6 | | Section 5. Medicaid budget and impact note required. Every | 7 | | bill that amends the Illinois Public Aid Code, affects | 8 | | eligibility for or enrollment in Medicaid, or has a financial | 9 | | impact on the operation of the Department of Healthcare and | 10 | | Family Services shall have prepared
for it, prior to second | 11 | | reading in each chamber, a brief explanatory
statement or note | 12 | | that includes a reliable estimate of the expected impact of the | 13 | | bill on the
annual budget of the Department of Healthcare and | 14 | | Family Services and the State of Illinois, as well as an | 15 | | accurate projection of the costs and benefits associated with | 16 | | the implementation of each provision in the bill.
| 17 | | Section 10. Request for and delivery of note. Upon the | 18 | | request of any member of the General Assembly, the Director of | 19 | | the Department of Healthcare and Family Services, or any person
| 20 | | within the Department whom the Director may designate, shall | 21 | | prepare a written
statement setting forth the information | 22 | | specified in Section
5.

| 1 | | The statement prepared by the Director of Healthcare and | 2 | | Family Services shall be
designated a Medicaid Budget and | 3 | | Impact Note and shall be furnished to the
member who made the | 4 | | request within 10 calendar days thereafter, except that | 5 | | whenever, because of
the complexity of the bill, additional | 6 | | time is required for the preparation
of the note, the | 7 | | Department of Healthcare and Family Services may so notify the | 8 | | requester and ask for an extension of time not
to exceed 5 | 9 | | additional days within which the note is to be furnished. No
| 10 | | extension shall extend beyond May 15 following the date of the | 11 | | request. | 12 | | Section 15. Contents of note. The note shall be factual in | 13 | | nature, as brief and concise as
may be, and shall provide as | 14 | | reliable an estimate, in terms of dollar and programmatic | 15 | | impact, as is possible under the circumstances. The note shall
| 16 | | include both the immediate effect, and if determinable or | 17 | | reasonably
foreseeable,
the long-range effect of the measure. | 18 | | The note shall also indicate the dollar amounts that will be | 19 | | received, from the federal government and other sources, and | 20 | | the amounts that are expected to be expended by the State.
| 21 | | If, after careful investigation, it is determined that no | 22 | | dollar estimate is possible, the note shall contain a statement | 23 | | to that
effect, setting forth the reasons why no such estimate | 24 | | can be given. A
brief summary or work sheet of computations and | 25 | | all assumptions used in arriving at the Medicaid Budget
and |

| 1 | | Impact Note figures
shall be supplied. | 2 | | No comment or opinion shall be included in the note with | 3 | | regard
to the merits of the measure for which the note is | 4 | | prepared; however, technical
or mechanical defects may be | 5 | | noted.
| 6 | | The work sheet shall include, insofar as practicable, a | 7 | | breakdown of the
costs and benefits upon which the note is | 8 | | based.
The note shall also include such other information as is | 9 | | required by the
rules and regulations that may be promulgated | 10 | | by each house of the General
Assembly with respect to the | 11 | | preparation of such notes.
| 12 | | The note shall be prepared in quintuplicate and the | 13 | | original of both the
note and the work sheet shall be signed by | 14 | | the Director of Healthcare and Family Services or such person | 15 | | as the Director may designate. | 16 | | Section 20. Appearance before legislative committee. The | 17 | | fact that a Medicaid Budget and Impact Note is prepared
for any | 18 | | bill shall not preclude or restrict the appearance before any | 19 | | committee
of the General Assembly, of any official or | 20 | | authorized employee of any State
board, commission, | 21 | | department, agency, or other entity who desires to be heard
in | 22 | | support of, or in opposition to, the measure. | 23 | | Section 25. Applicability to amendments. Whenever any | 24 | | measure is amended on the floor of either house

| 1 | | as to bring it within the description of bills set forth
in | 2 | | Section 5 above, a majority of such house may propose that no | 3 | | action
shall be taken upon the amendment until the Director of | 4 | | Healthcare and Family Services presents
a note that complies | 5 | | with the requirements of this Act. | 6 | | Section 30. Confidentiality. The subject matter of bills | 7 | | submitted to the Director of Healthcare and Family Services | 8 | | shall be kept in strict confidence, and no information
relating | 9 | | thereto or relating to the budget or impact thereof shall be | 10 | | divulged
by an official or employee of the Department of | 11 | | Healthcare and Family Services, except to the requester, or his | 12 | | or her designee, prior
to the bill's introduction in the | 13 | | General Assembly.
