AMENDMENT TO SENATE BILL 2780

AMENDMENT NO. ______. Amend Senate Bill 2780 by replacing everything after the enacting clause with the following:

"Section 5. The Criminal Code of 1961 is amended by adding Section 24-3.5-5 as follows:

(720 ILCS 5/24-3.5-5 new)

Sec. 24-3.5-5. Persons prohibited from receiving firearms under federal law; prohibited receipt, possession, transport, or carrying.

(a) It is unlawful for an individual in the course of their employment to receive, possess, transport, or carry any firearm or ammunition while: (1) being employed for any person who cannot own, possess, or acquire a firearm under 18 U.S.C. 922(g); and (2) having knowledge of the prohibition on ownership, possession or acquisition of firearms by that person.

(b) It is unlawful for an individual who cannot own, possess, or acquire a firearm under 18 U.S.C. 922 (g), to direct another person to receive, possess, transport, or carry any firearm or ammunition.

(c) Sentence. A violation of subsection (a) of this Section is a Class 3 felony. A violation of subsection (b) of this Section is a Class 1 felony.

Section 99. Effective date. This Act takes effect upon becoming law.".
