AMENDMENT TO SENATE BILL 637

2    AMENDMENT NO. ______. Amend Senate Bill 637, AS AMENDED,
3with reference to page and line numbers of Senate Amendment No.
41, on page 1, lines 4 and 5, by replacing "Section 27A-5.5"
5with "Sections 27A-5.5 and 27A-5.10"; and
 
6on page 1, immediately below line 9, by inserting the
7following:
 
8    "(105 ILCS 5/27A-5.10 new)
9    Sec. 27A-5.10. Waiver of fees.
10    (a) The governing body of a charter school shall waive all
11fees assessed by the charter school on children whose parents
12are unable to afford them, including, but not limited to,
13children living in households that meet the free lunch or
14breakfast eligibility guidelines established by the federal
15government pursuant to Section 1758 of the federal Richard B.
16Russell National School Lunch Act (42 U.S.C. 1758; 7 C.F.R. 245

1et seq.), subject to verification as set forth in subsection
2(b) of this Section. The governing body of the charter school
3shall develop written policies and procedures implementing
4this Section in accordance with rules adopted by the State
5Board of Education.
6    (b) If the governing body of a charter school participates
7in a federally funded, school-based, child nutrition program
8and uses a student's application for, eligibility for, or
9participation in the federally funded, school-based, child
10nutrition program (42 U.S.C. 1758; 7 C.F.R. 245 et seq.) as the
11basis for waiving fees assessed by the charter school, then the
12governing body of the charter school must follow the
13verification requirements of the federally funded,
14school-based, child nutrition program (42 U.S.C. 1758; 7 C.F.R.
15245.6a).
16    If the governing body of a charter school establishes a
17process for the determination of eligibility for waiver of fees
18assessed by the charter school that is completely independent
19of a student's application for, eligibility for, or
20participation in a federally funded, school-based, child
21nutrition program, then the governing body of the charter
22school may provide for fee waiver verification no more often
23than every 60 calendar days. Information obtained during the
24independent, fee waiver verification process indicating that
25the student does not meet free lunch or breakfast eligibility
26guidelines may be used to deny the waiver of the student's

1fees, provided that any information obtained through this
2independent process for determining or verifying eligibility
3for fee waivers shall not be used to determine or verify
4eligibility for any federally funded, school-based, child
5nutrition program.".
