AMENDMENT TO SENATE BILL 275

2    AMENDMENT NO. ______. Amend Senate Bill 275 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Civil Administrative Code of Illinois is
5amended by adding Section 5-715 as follows:
 
6    (20 ILCS 5/5-715 new)
7    Sec. 5-715. Expedited licensure for service members and
8spouses.
9    (a) In this Section, "service member" means any person who,
10at the time of application under this Section, is an active
11duty member of the United States Armed Forces or any reserve
12component of the United States Armed Forces or the National
13Guard of any state, commonwealth, or territory of the United
14States or the District of Columbia or whose active duty service
15concluded within the preceding 2 years before application.
16    (b) Each director of a department that issues an

1occupational or professional license is authorized to and shall
2issue an expedited temporary occupational or professional
3license to a service member who meets the requirements under
4this Section. The temporary occupational or professional
5license shall be valid for 6 months after the date of issuance
6or until a license is granted or a notice to deny a license is
7issued in accordance with rules adopted by the department
8issuing the license, whichever occurs first. No temporary
9occupational or professional license shall be renewed. The
10service member shall apply to the department on forms provided
11by the department. An application must include proof that:
12        (1) the applicant is a service member;
13        (2) the applicant holds a valid license in good
14    standing for the occupation or profession issued by another
15    state, commonwealth, possession, or territory of the
16    United States, the District of Columbia, or any foreign
17    jurisdiction and the requirements for licensure in the
18    other jurisdiction are determined by the department to be
19    substantially equivalent to the standards for licensure of
20    this State;
21        (3) the applicant is assigned to a duty station in this
22    State or has established legal residence in this State;
23        (4) a complete set of the applicant's fingerprints has
24    been submitted to the Department of State Police for
25    statewide and national criminal history checks, if
26    applicable to the requirements of the department issuing

1    the license; the applicant shall pay the fee to the
2    Department of State Police or to the fingerprint vendor for
3    electronic fingerprint processing; no temporary
4    occupational or professional license shall be issued to an
5    applicant if the statewide or national criminal history
6    check discloses information that would cause the denial of
7    an application for licensure under any applicable
8    occupational or professional licensing Act;
9        (5) the applicant is not ineligible for licensure
10    pursuant to Section 2105-165 of the Civil Administrative
11    Code of Illinois;
12        (6) the applicant has submitted an application for full
13    licensure; and
14        (7) the applicant has paid the required fee; fees shall
15    not be refundable.
16    (c) Each director of a department that issues an
17occupational or professional license is authorized to and shall

19license to the spouse of a service member who meets the
20requirements under this Section. The temporary occupational or
21professional license shall be valid for 6 months after the date
22of issuance or until a license is granted or a notice to deny a

3        (1) the applicant is the spouse of a service member;
4        (2) the applicant holds a valid license in good
5    standing for the occupation or profession issued by another
6    state, commonwealth, possession, or territory of the
7    United States, the District of Columbia, or any foreign
8    jurisdiction and the requirements for licensure in the
9    other jurisdiction are determined by the department to be
10    substantially equivalent to the standards for licensure of
11    this State;
12        (3) the applicant's spouse is assigned to a duty
13    station in this State or has established legal residence in
14    this State;
15        (4) a complete set of the applicant's fingerprints has
16    been submitted to the Department of State Police for
17    statewide and national criminal history checks, if
18    applicable to the requirements of the department issuing
19    the license; the applicant shall pay the fee to the

1        (5) the applicant is not ineligible for licensure
2    pursuant to Section 2105-165 of the Civil Administrative
3    Code of Illinois;
4        (6) the applicant has submitted an application for full
5    licensure; and
6        (7) the applicant has paid the required fee; fees shall
7    not be refundable.
8    (d) All relevant experience of a service member in the
9discharge of official duties, including full-time and
10part-time experience, shall be credited in the calculation of
11any years of practice in an occupation or profession as may be
12required under any applicable occupational or professional
13licensing Act. All relevant training provided by the military
14and completed by a service member shall be credited to that
15service member as meeting any training or education requirement
16under any applicable occupational or professional licensing
17Act, provided that the training or education is determined by
18the department to be substantially equivalent to that required
19under any applicable Act and is not otherwise contrary to any
20other licensure requirement.
21    (e) A department may adopt any rules necessary for the
22implementation and administration of this Section and shall by
23rule provide for fees for the administration of this Section.
 
24    Section 10. The School Code is amended by changing Section
2521B-20 as follows:

1    (105 ILCS 5/21B-20)
2    Sec. 21B-20. Types of licenses. Before July 1, 2013, the
3State Board of Education shall implement a system of educator
4licensure, whereby individuals employed in school districts
5who are required to be licensed must have one of the following
6licenses: (i) a professional educator license; (ii) a
7professional educator license with stipulations; or (iii) a
8substitute teaching license. References in law regarding
9individuals certified or certificated or required to be
10certified or certificated under Article 21 of this Code shall
11also include individuals licensed or required to be licensed
12under this Article. The first year of all licenses ends on June
1330 following one full year of the license being issued.
14    The State Board of Education, in consultation with the
15State Educator Preparation and Licensure Board, may adopt such
16rules as may be necessary to govern the requirements for
17licenses and endorsements under this Section.
18        (1) Professional Educator License. Persons who (i)
19    have successfully completed an approved educator
20    preparation program and are recommended for licensure by
21    the Illinois institution offering the educator preparation
22    program, (ii) have successfully completed the required
23    testing under Section 21B-30 of this Code, (iii) have
24    successfully completed coursework on the psychology of,
25    the identification of, and the methods of instruction for

1    the exceptional child, including without limitation the
2    learning disabled, (iv) have successfully completed
3    coursework in methods of reading and reading in the content
4    area, and (v) have met all other criteria established by
5    rule of the State Board of Education shall be issued a
6    Professional Educator License. All Professional Educator
7    Licenses are valid until June 30 immediately following 5
8    years of the license being issued. The Professional
9    Educator License shall be endorsed with specific areas and
10    grade levels in which the individual is eligible to
11    practice.
12        Individuals can receive subsequent endorsements on the
13    Professional Educator License. Subsequent endorsements
14    shall require a minimum of 24 semester hours of coursework
15    in the endorsement area, unless otherwise specified by
16    rule, and passage of the applicable content area test.
17        (2) Educator License with Stipulations. An Educator
18    License with Stipulations shall be issued an endorsement
19    that (i) is non-renewable, (ii) limits the license holder
20    to one particular position, or (iii) does not require
21    completion of an approved educator program or any
22    combination of items (i) through (iii) of this paragraph
23    (2).
24        An individual with an Educator License with
25    Stipulations must not be employed by a school district or
26    any other entity to replace any presently employed teacher

1    who otherwise would not be replaced for any reason.
2        An Educator License with Stipulations may be issued
3    with the following endorsements:
4            (A) Provisional educator. A provisional educator
5        endorsement in a specific content area or areas on an
6        Educator License with Stipulations may be issued to an
7        applicant who holds an educator license with a minimum
8        of 15 semester hours in content coursework from another
9        state, U.S. territory, or foreign country and who, at
10        the time of applying for an Illinois license, does not
11        meet the minimum requirements under Section 21B-35 of
12        this Code, but does, at a minimum, meet both of the
13        following requirements:
14                (i) Holds the equivalent of a minimum of a
15            bachelor's degree, unless a master's degree is
16            required for the endorsement, from a regionally
17            accredited college or university or, for
18            individuals educated in a country other than the
19            United States, the equivalent of a minimum of a
20            bachelor's degree issued in the United States,
21            unless a master's degree is required for the
22            endorsement.
23                (ii) Has passed a test of basic skills and
24            content area test, as required by Section 21B-30 of
25            this Code.
26    However, a provisional educator endorsement for principals

1    may not be issued, nor may any person with a provisional
2    educator endorsement serve as a principal in a public
3    school in this State. In addition, out-of-state applicants
4    shall not receive a provisional educator endorsement if the
5    person completed an alternative licensure program in
6    another state, unless the program has been determined to be
7    equivalent to Illinois program requirements.
8        Notwithstanding any other requirements of this
9    Section, a service member or spouse of a service member may
10    obtain a Professional Educator License with Stipulations,
11    and a provisional educator endorsement in a specific
12    content area or areas, if he or she holds a valid teaching
13    certificate or license in good standing from another state,
14    meets the qualifications of educators outlined in Section
15    21B-15 of this Code, and has not engaged in any misconduct
16    that would prohibit an individual from obtaining a license
17    pursuant to Illinois law, including without limitation any
18    administrative rules of the State Board of Education;
19    however, the service member or spouse may not serve as a
20    principal under the Professional Educator License with
21    Stipulations or provisional educator endorsement.
22        In this Section, "service member" means any person who,
23    at the time of application under this Section, is an active
24    duty member of the United States Armed Forces or any
25    reserve component of the United States Armed Forces or the
26    National Guard of any state, commonwealth, or territory of

1    the United States or the District of Columbia.
2        A provisional educator endorsement is valid until June
3    30 immediately following 2 years of the license being
4    issued, during which time any remaining testing and
5    coursework deficiencies must be met. Failure to satisfy all
6    stated deficiencies shall mean the individual, including
7    any service member or spouse who has obtained a
8    Professional Educator License with Stipulations and a
9    provisional educator endorsement in a specific content
10    area or areas, is ineligible to receive a Professional
11    Educator License at that time. A provisional educator
12    endorsement on an Educator License with Stipulations shall
13    not be renewed.
14            (B) Alternative provisional educator. An
15        alternative provisional educator endorsement on an
16        Educator License with Stipulations may be issued to an
17        applicant who, at the time of applying for the
18        endorsement, has done all of the following:
19                (i) Graduated from a regionally accredited
20            college or university with a minimum of a
21            bachelor's degree.
22                (ii) Successfully completed the first phase of
23            the Alternative Educator Licensure Program for
24            Teachers, as described in Section 21B-50 of this
25            Code.
26                (iii) Passed a test of basic skills and content

1            area test, as required under Section 21B-30 of this
2            Code.
3            The alternative provisional educator endorsement
4        is valid for 2 years of teaching and may be renewed for
5        a third year by an individual meeting the requirements
6        set forth in Section 21B-50 of this Code.
7            (C) Alternative provisional superintendent. An
8        alternative provisional superintendent endorsement on
9        an Educator License with Stipulations entitles the
10        holder to serve only as a superintendent or assistant
11        superintendent in a school district's central office.
12        This endorsement may only be issued to an applicant
13        who, at the time of applying for the endorsement, has
14        done all of the following:
15                (i) Graduated from a regionally accredited
16            college or university with a minimum of a master's
17            degree in a management field other than education.
18                (ii) Been employed for a period of at least 5
19            years in a management level position in a field
20            other than education.
21                (iii) Successfully completed the first phase
22            of an alternative route to superintendent
23            endorsement program, as provided in Section 21B-55
24            of this Code.
25                (iv) Passed a test of basic skills and content
26            area tests required under Section 21B-30 of this

1            Code.
2            The endorsement may be registered for 2 fiscal
3        years in order to complete one full year of serving as
4        a superintendent or assistant superintendent.
5            (D) Resident teacher endorsement. A resident
6        teacher endorsement on an Educator License with
7        Stipulations may be issued to an applicant who, at the
8        time of applying for the endorsement, has done all of
9        the following:
10                (i) Graduated from a regionally accredited
11            institution of higher education with a minimum of a
12            bachelor's degree.
13                (ii) Enrolled in an approved Illinois educator
14            preparation program.
15                (iii) Passed a test of basic skills and content
16            area test, as required under Section 21B-30 of this
17            Code.
18            The resident teacher endorsement on an Educator
19        License with Stipulations is valid for 4 years of
20        teaching and shall not be renewed.
21            A resident teacher may teach only under the
22        direction of a licensed teacher, who shall act as the
23        resident mentor teacher, and may not teach in place of
24        a licensed teacher. A resident teacher endorsement on
25        an Educator License with Stipulations shall no longer
26        be valid after June 30, 2017.

1            (E) Career and technical educator. A career and
2        technical educator endorsement on an Educator License
3        with Stipulations may be issued to an applicant who has
4        a minimum of 60 semester hours of coursework from a
5        regionally accredited institution of higher education,
6        has passed a test of basic skills required under
7        Section 21B-30 of this Code, and has a minimum of 2,000
8        hours of experience in the last 10 years outside of
9        education in each area to be taught.
10            The career and technical educator endorsement on
11        an Educator License with Stipulations is valid until
12        June 30 immediately following 5 years of the
13        endorsement being issued.
14            (F) Provisional career and technical educator. A
15        Provisional career and technical educator endorsement
16        on an Educator License with Stipulations may be issued
17        to an applicant who has a minimum of 8,000 hours of
18        work experience in the skill for which the applicant is
19        seeking the endorsement. It is the responsibility of
20        each employing school board and regional office of
21        education to provide verification, in writing, to the
22        State Superintendent of Education at the time the
23        application is submitted that no qualified teacher
24        holding a Professional Educator License or an Educator
25        License with Stipulations with a career and technical
26        educator endorsement is available and that actual

1        circumstances require such issuance.
2            The provisional career and technical educator
3        endorsement on an Educator License with Stipulations
4        is valid until June 30 immediately following 5 years of
5        the endorsement being issued and may be renewed only
6        one time for 5 years if the individual passes a test of
7        basic skills, as required under Section 21B-30 of this
8        Code, and has completed a minimum of 20 semester hours
9        from a regionally accredited institution.
10            (G) Transitional bilingual educator. A
11        transitional bilingual educator endorsement on an
12        Educator License with Stipulations may be issued for
13        the purpose of providing instruction in accordance
14        with Article 14C of this Code to an applicant who
15        provides satisfactory evidence that he or she meets all
16        of the following requirements:
17                (i) Possesses adequate speaking, reading, and
18            writing ability in the language other than English
19            in which transitional bilingual education is
20            offered.
21                (ii) Has the ability to successfully
22            communicate in English.
23                (iii) Either possessed, within 5 years
24            previous to his or her applying for a transitional
25            bilingual educator endorsement, a valid and
26            comparable teaching certificate or comparable

1            authorization issued by a foreign country or holds
2            a degree from an institution of higher learning in
3            a foreign country that the State Educator
4            Preparation and Licensure Board determines to be
5            the equivalent of a bachelor's degree from a
6            regionally accredited institution of higher
7            learning in the United States.
8            A transitional bilingual educator endorsement
9        shall be valid for prekindergarten through grade 12, is
10        valid until June 30 immediately following 5 years of
11        the endorsement being issued, and shall not be renewed.
12            Persons holding a transitional bilingual educator
13        endorsement shall not be employed to replace any
14        presently employed teacher who otherwise would not be
15        replaced for any reason.
16            (H) Language endorsement. In an effort to
17        alleviate the shortage of teachers speaking a language
18        other than English in the public schools, an individual
19        who holds an Educator License with Stipulations may
20        also apply for a language endorsement, provided that
21        the applicant provides satisfactory evidence that he
22        or she meets all of the following requirements:
23                (i) Holds a transitional bilingual
24            endorsement.
25                (ii) Has demonstrated proficiency in the
26            language for which the endorsement is to be issued

1            by passing the applicable language content test
2            required by the State Board of Education.
3                (iii) Holds a bachelor's degree or higher from
4            a regionally accredited institution of higher
5            education or, for individuals educated in a
6            country other than the United States, holds a
7            degree from an institution of higher learning in a
8            foreign country that the State Educator
9            Preparation and Licensure Board determines to be
10            the equivalent of a bachelor's degree from a
11            regionally accredited institution of higher
12            learning in the United States.
13                (iv) Has passed a test of basic skills, as
14            required under Section 21B-30 of this Code.
15            A language endorsement on an Educator License with
16        Stipulations is valid for prekindergarten through
17        grade 12 for the same validity period as the
18        individual's transitional bilingual educator
19        endorsement on the Educator License with Stipulations
20        and shall not be renewed.
21            (I) Visiting international educator. A visiting
22        international educator endorsement on an Educator
23        License with Stipulations may be issued to an
24        individual who is being recruited by a particular
25        school district that conducts formal recruitment
26        programs outside of the United States to secure the

1        services of qualified teachers and who meets all of the
2        following requirements:
3                (i) Holds the equivalent of a minimum of a
4            bachelor's degree issued in the United States.
5                (ii) Has been prepared as a teacher at the
6            grade level for which he or she will be employed.
7                (iii) Has adequate content knowledge in the
8            subject to be taught.
9                (iv) Has an adequate command of the English
10            language.
11            A holder of a visiting international educator
12        endorsement on an Educator License with Stipulations
13        shall be permitted to teach in bilingual education
14        programs in the language that was the medium of
15        instruction in his or her teacher preparation program,
16        provided that he or she passes the English Language
17        Proficiency Examination or another test of writing
18        skills in English identified by the State Board of
19        Education, in consultation with the State Educator
20        Preparation and Licensure Board.
21            A visiting international educator endorsement on
22        an Educator License with Stipulations is valid for 3
23        years and shall not be renewed.
24            (J) Paraprofessional educator. A paraprofessional
25        educator endorsement on an Educator License with
26        Stipulations may be issued to an applicant who holds a

1        high school diploma or its recognized equivalent and
2        either holds an associate's degree or a minimum of 60
3        semester hours of credit from a regionally accredited
4        institution of higher education or has passed a test of
5        basic skills required under Section 21B-30 of this
6        Code. The paraprofessional educator endorsement is
7        valid until June 30 immediately following 5 years of
8        the endorsement being issued and may be renewed through
9        application and payment of the appropriate fee, as
10        required under Section 21B-40 of this Code. An
11        individual who holds only a paraprofessional educator
12        endorsement is not subject to additional requirements
13        in order to renew the endorsement.
14        (3) Substitute Teaching License. A Substitute Teaching
15    License may be issued to qualified applicants for
16    substitute teaching in all grades of the public schools,
17    prekindergarten through grade 12. Substitute Teaching
18    Licenses are not eligible for endorsements. Applicants for
19    a Substitute Teaching License must hold a bachelor's degree
20    or higher from a regionally accredited institution of
21    higher education.
22        Substitute Teaching Licenses are valid for 5 years and
23    may be renewed if the individual has passed a test of basic
24    skills, as authorized under Section 21B-30 of this Code. An
25    individual who has passed a test of basic skills for the
26    first licensure renewal is not required to retake the test

1    again for further renewals.
2        Substitute Teaching Licenses are valid for substitute
3    teaching in every county of this State. If an individual
4    has had his or her Professional Educator License or
5    Educator License with Stipulations suspended or revoked or
6    has not met the renewal requirements for licensure, then
7    that individual is not eligible to obtain a Substitute
8    Teaching License.
9        A substitute teacher may only teach in the place of a
10    licensed teacher who is under contract with the employing
11    board. If, however, there is no licensed teacher under
12    contract because of an emergency situation, then a district
13    may employ a substitute teacher for no longer than 30
14    calendar days per each vacant position in the district if
15    the district notifies the appropriate regional office of
16    education within 5 business days after the employment of
17    the substitute teacher in the emergency situation. An
18    emergency situation is one in which an unforeseen vacancy
19    has occurred and (i) a teacher is unable to fulfill his or
20    her contractual duties or (ii) teacher capacity needs of
21    the district exceed previous indications, and the district
22    is actively engaged in advertising to hire a fully licensed
23    teacher for the vacant position.
24        There is no limit on the number of days that a
25    substitute teacher may teach in a single school district,
26    provided that no substitute teacher may teach for longer

1    than 90 school days for any one licensed teacher under
2    contract in the same school year. A substitute teacher who
3    holds a Professional Educator License or Educator License
4    with Stipulations shall not teach for more than 120 school
5    days for any one licensed teacher under contract in the
6    same school year. The limitations in this paragraph (3) on
7    the number of days a substitute teacher may be employed do
8    not apply to any school district operating under Article 34
9    of this Code.
