1 AMENDMENT TO SENATE BILL 91
2     AMENDMENT NO. ______. Amend Senate Bill 91 by replacing
3 everything after the enacting clause with the following:

4     "Section 5. The Fox Waterway Agency Act is amended by
5 changing Section 3 and by adding Section 3.1 as follows:

6     (615 ILCS 90/3)  (from Ch. 19, par. 1203)
7     Sec. 3. As used in this Act, unless the context otherwise
8 requires:
9     (a) "Agency" means the Fox Waterway Agency created by this
10 Act.
11     (b) "Board" means the board of directors of the Fox
12 Waterway Agency.
13     (c) "Director" means a member of the board of directors of
14 the Fox Waterway Agency.
15     (d) "Member County" means that portion of either Lake
16 County or McHenry County which lies within the territory of the

1 Agency.
2     (e) "Chain of Lakes Fox River Recreational Waterway" or
3 "waterway" ~~"Waterway"~~ means the Fox River and interconnecting
4 lakes commonly known as the Chain O Lakes from the Wisconsin
5 State line to the Algonquin Dam, all within the State of
6 Illinois, and includes all streams, bayous, sloughs,
7 backwaters, side channels, improved channels, and submerged
8 lands or parts thereof which lie within the territory of the
9 Agency.

12     Sec. 3.1. Public use. All waters within the waterway are
13 open to the public for navigation and fishing.

14     Section 99. Effective date. This Act takes effect upon
15 becoming law.".
