| 5 | | "Section 5. The General Assembly Compensation Act is | 6 | | amended by changing Section 1 and by adding Section 1.8 as | 7 | | follows: | 8 | | (25 ILCS 115/1) (from Ch. 63, par. 14) | 9 | | Sec. 1. Each member of the General Assembly shall receive | 10 | | an annual salary
of $28,000 or as set by the Compensation | 11 | | Review Board, whichever is
greater. The
following named | 12 | | officers, committee chairmen and committee minority spokesmen
| 13 | | shall receive additional amounts per year for
their services as | 14 | | such officers, committee chairmen and committee
minority | 15 | | spokesmen respectively, as set by the Compensation

| 1 | | Assembly, including the additional sums payable per year
to | 2 | | officers of the General Assembly shall be paid in 12 equal | 3 | | monthly
installments. The first such installment is payable on | 4 | | January 31,
1977. All subsequent equal monthly installments are | 5 | | payable on the last
working day of the month. A member who has | 6 | | held office any part of a
month is entitled to compensation for | 7 | | an entire month. | 8 | | Mileage shall be paid at the rate of 20 cents per mile | 9 | | before January
9, 1985, and at the mileage allowance rate in | 10 | | effect under regulations
promulgated pursuant to 5 U.S.C. | 11 | | 5707(b)(2) beginning January 9, 1985, for the number
of actual | 12 | | highway miles necessarily and conveniently traveled by the
most | 13 | | feasible route to be present upon convening of the sessions of | 14 | | the
General Assembly by such member in each and every trip | 15 | | during each
session in going to and returning from the seat of | 16 | | government, to be
computed by the Comptroller. A member | 17 | | traveling by public
transportation for such purposes, however, | 18 | | shall be paid his actual cost
of that transportation instead of | 19 | | on the mileage rate if his cost of
public transportation | 20 | | exceeds the amount to which he would be entitled
on a mileage | 21 | | basis. No member may be paid, whether on a mileage basis
or for | 22 | | actual costs of public transportation, for more than one such
| 23 | | trip for each week the General Assembly is actually in session. | 24 | | Each
member shall also receive an allowance of $36 per day for | 25 | | lodging and
meals while in attendance at sessions
of the | 26 | | General Assembly before January 9, 1985; beginning January 9,

| 1 | | 1985, such food and lodging allowance shall be equal to the | 2 | | amount per day
permitted to be deducted for such expenses under | 3 | | the Internal Revenue Code;
however, beginning May 31, 1995, no | 4 | | allowance for food and lodging while in
attendance at sessions | 5 | | is authorized for periods of time after the last day in
May of | 6 | | each calendar year, except (i) if the General Assembly is | 7 | | convened in
special session by either the Governor or the | 8 | | presiding officers of both
houses, as provided by subsection | 9 | | (b) of Section 5 of Article IV of the
Illinois Constitution or | 10 | | (ii) if the
General Assembly is convened to consider bills | 11 | | vetoed, item vetoed, reduced, or
returned with specific | 12 | | recommendations for change by the Governor as provided
in | 13 | | Section 9 of Article IV of the Illinois Constitution. For | 14 | | Notwithstanding any other provision, for fiscal year 2011 and | 15 | | for session days in fiscal years year 2012 and 2013 only (i) | 16 | | the allowance for lodging and meals is $111 per day and (ii) | 17 | | mileage for automobile travel shall be reimbursed at a rate of | 18 | | $0.39 per mile. | 19 | | Notwithstanding any other provision of law to the contrary, | 20 | | beginning in fiscal year 2012, travel reimbursement for
General | 21 | | Assembly members on non-session days shall be
calculated using | 22 | | the guidelines set forth by the Legislative
Travel Control | 23 | | Board, except that fiscal year 2012 and 2013 mileage | 24 | | reimbursement is set at a rate of $0.39 per mile. | 25 | | If a member dies having received only a portion of the | 26 | | amount payable
as compensation, the unpaid balance shall be |

| 1 | | paid to the surviving
spouse of such member, or, if there be | 2 | | none, to the estate of such member. | 3 | | (Source: P.A. 96-958, eff. 7-1-10; 97-71, eff. 6-30-11.) | 4 | | (25 ILCS 115/1.8 new) | 5 | | Sec. 1.8. FY13 furlough days. During the first 6 months of
| 6 | | the fiscal year beginning July 1, 2012, every member of the
| 7 | | 97th General Assembly is mandatorily required to forfeit one
| 8 | | day of compensation. The State Comptroller shall deduct the
| 9 | | equivalent of 1/261st of the annual salary of each member of
| 10 | | the 97th General Assembly from the compensation of that member
| 11 | | in each of the first 6 months of the fiscal year. During the
| 12 | | second 6 months of the fiscal year beginning July 1, 2012,
| 13 | | every member of the 98th General Assembly is mandatorily
| 14 | | required to forfeit one day of compensation. The State
| 15 | | Comptroller shall deduct the equivalent of 1/261st of the
| 16 | | annual salary of each member of the 98th General Assembly from
| 17 | | the compensation of that member in each of the second 6 months
| 18 | | of the fiscal year. For purposes of this Section, annual
| 19 | | compensation includes compensation paid to each member by the
| 20 | | State for one year of service pursuant to Section 1, except any
| 21 | | payments made for mileage and allowances for travel and meals. | 22 | | The forfeiture required by this Section is not considered a
| 23 | | change in salary and shall not impact pension or other benefits
| 24 | | provided to members of the General Assembly. |

| 1 | | Section 10. The Compensation Review Act is amended by | 2 | | adding Section 5.9 as follows: | 3 | | (25 ILCS 120/5.9 new) | 4 | | Sec. 5.9. FY13 COLAs prohibited. Notwithstanding any | 5 | | former or current provision of this Act, any other law, any | 6 | | report of the Compensation Review Board, or any resolution of | 7 | | the General Assembly to the contrary, members of the General | 8 | | Assembly, State's attorneys, other than the county supplement, | 9 | | elected executive branch constitutional officers of State | 10 | | government, and persons in certain appointed offices of State | 11 | | government, including the membership of State departments, | 12 | | agencies, boards, and commissions, whose annual compensation | 13 | | previously was recommended or determined by the Compensation | 14 | | Review Board, are prohibited from receiving and shall not | 15 | | receive any increase in compensation that would otherwise apply | 16 | | based on a cost of living adjustment, as authorized by Senate | 17 | | Joint Resolution 192 of the 86th General Assembly, for or | 18 | | during the fiscal year beginning July 1, 2012. That cost of
| 19 | | living adjustment shall apply again in the fiscal year
| 20 | | beginning July 1, 2013 and thereafter.
| 21 | | Section 99. Effective date. This Act takes effect upon | 22 | | becoming law.".
