AMENDMENT TO HOUSE BILL 1521

2    AMENDMENT NO. ______. Amend House Bill 1521, on page 2, by
3replacing lines 2 through 6 with the following:
4    "(b) For facilities licensed under this Act, the Office of
5the State Fire Marshal shall provide the necessary fire
6inspection to comply with licensing requirements. The Office of
7the State Fire Marshal may enter into an agreement with another
8State agency to conduct this inspection if qualified personnel
9are employed by that agency. Code enforcement inspection of the
10facility by the local authority shall only occur if the local
11authority having jurisdiction enforces code requirements that
12are more stringent than those enforced by the State Fire
13Marshal. Nothing in this Section shall prohibit a local fire
14authority from conducting fire incident planning activities.";
15and
 
16on page 3, by replacing lines 4 through 8 with the following:
17    "(b) For facilities licensed under this Act, the Office of

1the State Fire Marshal shall provide the necessary fire
2inspection to comply with licensing requirements. The Office of
3the State Fire Marshal may enter into an agreement with another

7authority having jurisdiction enforces code requirements that
8are more stringent than those enforced by the State Fire

12on page 4, by replacing lines 7 through 12 with the following:
13    "(b) For community-integrated living arrangements licensed
14under this Act, the Office of the State Fire Marshal shall
15provide the necessary fire inspection to comply with licensing
16requirements. The Office of the State Fire Marshal may enter
17into an agreement with another State agency to conduct this
18inspection if qualified personnel are employed by that agency.
19Code enforcement inspection of the facility by the local
20authority shall only occur if the local authority having
21jurisdiction enforces code requirements that are more
22stringent than those enforced by the State Fire Marshal.
23Nothing in this Section shall prohibit a local fire authority

2    "(b) For child care facilities licensed under this Act, the
3Office of the State Fire Marshal shall provide the necessary
4fire inspection to comply with licensing requirements. The
5Office of the State Fire Marshal may enter into an agreement
6with another State agency to conduct this inspection if
7qualified personnel are employed by that agency. Code
8enforcement inspection of the facility by the local authority
9shall only occur if the local authority having jurisdiction
10enforces code requirements that are more stringent than those
11enforced by the State Fire Marshal. Nothing in this Section
12shall prohibit a local fire authority from conducting fire
13incident planning activities."; and
 
14on page 6, by replacing lines 13 through 18 with the following:
15    "(b) For provider organizations established under this
16Act, the Office of the State Fire Marshal shall provide the
17necessary fire inspection to comply with this Act. The Office
18of the State Fire Marshal may enter into an agreement with
19another State agency to conduct this inspection if qualified
20personnel are employed by that agency. Code enforcement
21inspection of the facility by the local authority shall only
22occur if the local authority having jurisdiction enforces code
23requirements that are more stringent than those enforced by the
24State Fire Marshal. Nothing in this Section shall prohibit a
