AMENDMENT TO HOUSE BILL 1516

2    AMENDMENT NO. ______. Amend House Bill 1516 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Employees Group Insurance Act of 1971
5is amended by adding Section 2.5 as follows:
 
6    (5 ILCS 375/2.5 new)
7    Sec. 2.5. Application to Commuter Rail Board members. This
8Act does not apply to any member of the Commuter Rail Board
9appointed or reappointed on or after the effective date of this
10amendatory Act of the 97th General Assembly.
 
11    Section 10. The Illinois Pension Code is amended by adding
12Section 22-105 as follows:
 
13    (40 ILCS 5/22-105 new)
14    Sec. 22-105. Application to Commuter Rail Board members.

1This Code does not apply to any member of the Commuter Rail
2Board appointed or reappointed on or after the effective date
3of this amendatory Act of the 97th General Assembly.
 
4    Section 25. The Regional Transportation Authority Act is
5amended by changing Sections 3B.02 and 3B.06 as follows:
 
6    (70 ILCS 3615/3B.02)  (from Ch. 111 2/3, par. 703B.02)
7    Sec. 3B.02. Commuter Rail Board.
8    (a) (Blank). Until April 1, 2008, the governing body of the
9Commuter Rail Division shall be a board consisting of 7
10directors appointed pursuant to Sections 3B.03 and 3B.04, as
11follows:
12        (1) One director shall be appointed by the Chairman of
13    the Board of DuPage County with the advice and consent of
14    the County Board of DuPage County and shall reside in
15    DuPage County.
16        (2) Two directors appointed by the Chairmen of the
17    County Boards of Kane, Lake, McHenry and Will Counties with
18    the concurrence of not less than a majority of the chairmen
19    from such counties, from nominees by the Chairmen. Each
20    such chairman may nominate not more than two persons for
21    each position. Each such director shall reside in a county
22    in the metropolitan region other than Cook or DuPage
23    County.
24        (3) Three directors appointed by the members of the

1    Cook County Board elected from that part of Cook County
2    outside of Chicago, or, in the event such Board of
3    Commissioners becomes elected from single member
4    districts, by those Commissioners elected from districts,
5    a majority of the residents of which reside outside
6    Chicago. In either case, such appointment shall be with the
7    concurrence of four such Commissioners. Each such director
8    shall reside in that part of Cook County outside Chicago.
9        (4) One director appointed by the Mayor of the City of
10    Chicago, with the advice and consent of the City Council of
11    the City of Chicago. Such director shall reside in the City
12    of Chicago.
13        (5) The chairman shall be appointed by the directors,
14    from the members of the board, with the concurrence of 5 of
15    such directors.
16    (b) Until the effective date of this amendatory Act of the
1797th General Assembly, After April 1, 2008 the governing body
18of the Commuter Rail Division shall be a board consisting of 11
19directors appointed, pursuant to Sections 3B.03 and 3B.04, as
20follows:
21        (1) One Director shall be appointed by the Chairman of
22    the DuPage County Board with the advice and consent of the
23    DuPage County Board and shall reside in DuPage County. To
24    implement the changes in appointing authority under this
25    Section, upon the expiration of the term of or vacancy in
26    office of the Director appointed under item (1) of

1    subsection (a) of this Section who resides in DuPage
2    County, a Director shall be appointed under this
3    subparagraph.
4        (2) One Director shall be appointed by the Chairman of
5    the McHenry County Board with the advice and consent of the
6    McHenry County Board and shall reside in McHenry County. To
7    implement the change in appointing authority under this
8    Section, upon the expiration of the term of or vacancy in
9    office of the Director appointed under item (2) of
10    subsection (a) of this Section who resides in McHenry
11    County, a Director shall be appointed under this
12    subparagraph.
13        (3) One Director shall be appointed by the Will County
14    Executive with the advice and consent of the Will County
15    Board and shall reside in Will County. To implement the
16    change in appointing authority under this Section, upon the
17    expiration of the term of or vacancy in office of the
18    Director appointed under item (2) of subsection (a) of this
19    Section who resides in Will County, a Director shall be
20    appointed under this subparagraph.
21        (4) One Director shall be appointed by the Chairman of
22    the Lake County Board with the advice and consent of the
23    Lake County Board and shall reside in Lake County.
24        (5) One Director shall be appointed by the Chairman of
25    the Kane County Board with the advice and consent of the
26    Kane County Board and shall reside in Kane County.

1        (6) One Director shall be appointed by the Mayor of the
2    City of Chicago with the advice and consent of the City
3    Council of the City of Chicago and shall reside in the City
4    of Chicago. To implement the changes in appointing
5    authority under this Section, upon the expiration of the
6    term of or vacancy in office of the Director appointed
7    under item (4) of subsection (a) of this Section who
8    resides in the City of Chicago, a Director shall be
9    appointed under this subparagraph.
10        (7) Five Directors residing in Cook County outside of
11    the City of Chicago, as follows:
12            (i) One Director who resides in Cook County outside
13        of the City of Chicago, appointed by the President of
14        the Cook County Board with the advice and consent of
15        the members of the Cook County Board.
16            (ii) One Director who resides in the township of
17        Barrington, Palatine, Wheeling, Hanover, Schaumburg,
18        or Elk Grove. To implement the changes in appointing
19        authority under this Section, upon the expiration of
20        the term of or vacancy in office of the Director
21        appointed under paragraph (3) of subsection (a) of this
22        Section who resides in the geographic area described in
23        this subparagraph, a Director shall be appointed under
24        this subparagraph.
25            (iii) One Director who resides in the township of
26        Northfield, New Trier, Maine, Niles, Evanston, Leyden,

1        Norwood Park, River Forest, or Oak Park.
2            (iv) One Director who resides in the township of
3        Proviso, Riverside, Berwyn, Cicero, Lyons, Stickney,
4        Lemont, Palos, or Orland. To implement the changes in
5        appointing authority under this Section, upon the
6        expiration of the term of or vacancy in office of the
7        Director appointed under paragraph (3) of subsection
8        (a) of this Section who resides in the geographic area
9        described in this subparagraph and whose term of office
10        had not expired as of August 1, 2007, a Director shall
11        be appointed under this subparagraph.
12            (v) One Director who resides in the township of
13        Worth, Calumet, Bremen, Thornton, Rich, or Bloom. To
14        implement the changes in appointing authority under
15        this Section, upon the expiration of the term of or
16        vacancy in office of the Director appointed under
17        paragraph (3) of subsection (a) of this Section who
18        resides in the geographic area described in this
19        subparagraph and whose term of office had expired as of
20        August 1, 2007, a Director shall be appointed under
21        this subparagraph.
22            (vi) The Directors identified under the provisions
23        of subparagraphs (ii) through (v) of this paragraph (7)
24        shall be appointed by the members of the Cook County
25        Board. Each individual Director shall be appointed by
26        those members of the Cook County Board whose Board

1        districts overlap in whole or in part with the
2        geographic territory described in the relevant
3        subparagraph. The vote of County Board members
4        eligible to appoint directors under the provisions of
5        subparagraphs (ii) through (v) of this paragraph (7)
6        shall be weighted by the number of electors residing in
7        those portions of their Board districts within the
8        geographic territory described in the relevant
9        subparagraph (ii) through (v) of this paragraph (7).
10        (8) The Chairman shall be appointed by the Directors,
11    from the members of the Board, with the concurrence of 8 of
12    such Directors. To implement the changes in appointing
13    authority under this Section, upon the expiration of the
14    term of or vacancy in office of the Chairman appointed
15    under item (5) of subsection (a) of this Section, a
16    Chairman shall be appointed under this subparagraph.
17    (b-5) Notwithstanding any provision of this Article to the
18contrary, the term of office of each Director serving on the
19effective date of this amendatory Act of the 97th General
20Assembly expires on that effective date. On and after the
21effective date of this amendatory Act of the 97th General
22Assembly the governing body of the Commuter Rail Division shall
23be a board consisting of 11 directors appointed, pursuant to
24this subsection (b-5) and Sections 3B.03 and 3B.04, as follows:
25        (1) One Director shall be appointed by the Chairman of
26    the DuPage County Board with the advice and consent of the

1    DuPage County Board and shall reside in DuPage County.
2        (2) One Director shall be appointed by the Chairman of
3    the McHenry County Board with the advice and consent of the
4    McHenry County Board and shall reside in McHenry County.
5        (3) One Director shall be appointed by the Will County
6    Executive with the advice and consent of the Will County
7    Board and shall reside in Will County.
8        (4) One Director shall be appointed by the Chairman of
9    the Lake County Board with the advice and consent of the
10    Lake County Board and shall reside in Lake County.
11        (5) One Director shall be appointed by the Chairman of
12    the Kane County Board with the advice and consent of the
13    Kane County Board and shall reside in Kane County.
14        (6) One Director shall be appointed by the Mayor of the
15    City of Chicago with the advice and consent of the City
16    Council of the City of Chicago and shall reside in the City
17    of Chicago.
18        (7) Five Directors shall reside in Cook County outside
19    of the City of Chicago, as follows:
20            (i) One Director who resides in Cook County outside
21        of the City of Chicago, appointed by the President of
22        the Cook County Board with the advice and consent of
23        the members of the Cook County Board.
24            (ii) One Director who resides in the township of
25        Barrington, Palatine, Wheeling, Hanover, Schaumburg,

1            (iii) One Director who resides in the township of

9        The Directors identified under the provisions of
10    subparagraphs (ii) through (v) of this paragraph (7) shall
11    be appointed by the members of the Cook County Board. Each
12    individual Director shall be appointed by those members of
13    the Cook County Board whose Board districts overlap in
14    whole or in part with the geographic territory described in
15    the relevant subparagraph. The vote of County Board members
16    eligible to appoint directors under the provisions of
17    subparagraphs (ii) through (v) of this paragraph (7) shall
18    be weighted by the number of electors residing in those
19    portions of their Board districts within the geographic
20    territory described in the relevant subparagraph (ii)
21    through (v) of this paragraph (7).
22    The Chairman shall be appointed by the Directors, from the
23members of the Board, with the concurrence of 8 of the
24Directors.
25    (c) No director, while serving as such, shall be an
26officer, a member of the board of directors or trustee or an

1employee of any transportation agency, or be an employee of the
2State of Illinois or any department or agency thereof, or of
3any unit of local government or receive any compensation from
4any elected or appointed office under the Constitution and laws
5of Illinois.
6    (d) Each appointment made under subsections (a) and (b) of
7this Section and under Section 3B.03 shall be certified by the
8appointing authority to the Commuter Rail Board which shall
9maintain the certifications as part of the official records of
10the Commuter Rail Board.

13    Sec. 3B.06. Compensation; pension; benefits.
14    (a) This subsection (a) applies to members of the Commuter
15Rail Board, including the chairman, appointed before the
16effective date of this amendatory Act of the 97th General
17Assembly. The Chairman of the Commuter Rail Board shall receive
18an annual salary of $25,000. Other members of the Commuter Rail
19Board shall receive an annual salary of $15,000. Each member
20shall be reimbursed for actual expenses incurred in the
21performance of his or her duties.
22    (b) This subsection (b) applies to members of the Commuter
23Rail Board, including the chairman, appointed or reappointed on
24or after the effective date of this amendatory Act of the 97th
25General Assembly. Members of the Commuter Rail Board shall

1receive no annual salary or other compensation for their
2service in office, except that each member shall be reimbursed
3for actual expenses incurred in the performance of his or her
4duties. No service or contribution shall be credited in any
5retirement system or pension fund, under the Illinois Pension
6Code or otherwise, to any member of the Board for service in
7that office, and no public funds shall be appropriated,
8expended, or otherwise obligated for such a retirement system
9or pension fund credit. No member of the Board shall receive a
10financial benefit or perquisite for his or her service in such
11office, including without limitation participation in a
12program of life or health insurance.
13    (c) Officers of the Division shall not be required to
14comply with the requirements of the Public Funds Statement
15Publication Act "An Act requiring certain custodians of public
16monies to file and publish statements of the receipts and
17disbursements thereof", approved June 24, 1919, as now or
18hereafter amended.

20    Section 99. Effective date. This Act takes effect upon
21becoming law.".
