1 AMENDMENT TO HOUSE BILL 1316
2     AMENDMENT NO. ______. Amend House Bill 1316 by replacing
3 everything after the enacting clause with the following:

4     "Section 5. The Department of State Police Law of the Civil
5 Administrative Code of Illinois is amended by adding Section
6 2605-407 as follows:

7     (20 ILCS 2605/2605-407 new)
8     Sec. 2605-407. Illinois State Police Projects Trust Fund.
9 The Illinois State Police Projects Trust Fund is created as a
10 trust fund in the State treasury. This Trust Fund is
11 established to receive funds awarded to the Department of State
12 Police from the following: (i) all federal departments and
13 agencies for the specific purposes established by the terms and
14 conditions of the federal awards and (ii) pass-through grants
15 from State departments and agencies for the specific purposes
16 established by the terms and conditions of the grant

1 agreements. All interest earned by the investment or deposit of
2 moneys accumulated in the Trust Fund shall be deposited into
3 the Trust Fund.

4     Section 10. The Illinois Emergency Management Agency Act is
5 amended by adding Section 17.5 as follows:

6     (20 ILCS 3305/17.5 new)
7     Sec. 17.5. Homeland Security Emergency Preparedness Fund.
8 The Homeland Security Emergency Preparedness Fund is created as
9 a special fund in the State treasury. The Fund shall be held
10 separate and apart from all public moneys or funds of this
11 State. All moneys received by the Agency under Section 17 from
12 a federal department or agency shall be deposited into the
13 Fund. Interest earned by the investment or deposit of moneys
14 accumulated in the Fund shall be deposited into the Fund. The
15 Agency is authorized to expend any moneys in the Fund for the
16 specific purposes established by the terms and conditions of
17 the federal awards received by the Agency and in any amount
18 that the Agency deems necessary to make grants and pay expenses
19 in connection with its emergency management and preparedness
20 programs.

21     Section 15. The Illinois Motor Vehicle Theft Prevention Act
22 is amended by adding Section 8.5 as follows:

1     (20 ILCS 4005/8.5 new)
2     Sec. 8.5. State Police Motor Vehicle Theft Prevention Trust
3 Fund. The State Police Motor Vehicle Theft Prevention Trust
4 Fund is created as a trust fund in the State treasury. The
5 State Treasurer shall be the custodian of the Trust Fund. The
6 Trust Fund is established to receive funds from the Illinois
7 Motor Vehicle Theft Prevention Council. All interest earned
8 from the investment or deposit of moneys accumulated in the
9 Trust Fund shall be deposited into the Trust Fund. Moneys in
10 the Trust Fund shall be used by the Department of State Police
11 for motor vehicle theft prevention purposes.

12     Section 20. The State Finance Act is amended by adding
13 Section 5.786 as follows:

14     (30 ILCS 105/5.786 new)
15     Sec. 5.786. The Homeland Security Emergency Preparedness
16 Fund.".
