AMENDMENT TO HOUSE BILL 1091

AMENDMENT NO. ______. Amend House Bill 1091 on page 7, line 25, by inserting after the period the following:

"The Authority may operate or provide operational services such as toll collection on highways which are developed or financed, or both, through a public-private agreement entered into by another public entity."; and

on page 46, line 16, by inserting after the period the following: "To implement the powers conferred by this Act, the transportation agency may establish rules and procedures for the procurement of a public-private agreement under this Act. Nothing contained in this Act is intended to supersede applicable federal law or to foreclose the use or potential use of federal funds. In the event any provision of this Act is inconsistent with applicable federal law or would have the effect of foreclosing the use or potential use of federal funds, the applicable federal law or funding condition shall prevail, but only to the extent of such inconsistency.".
