AMENDMENT TO HOUSE BILL 6202

2     AMENDMENT NO. ______. Amend House Bill 6202, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Public Utilities Act is amended by adding
6 Section 16-107.7 as follows:
 
7     (220 ILCS 5/16-107.7 new)
8     Sec. 16-107.7. Net Metering Task Force.
9     (a) The General Assembly finds and declares all of the
10 following:
11         (1) In Public Act 95-420, the General Assembly found
12     and declared that a program to provide net electricity
13     metering can (i) encourage private investment in renewable
14     energy resources, (ii) stimulate economic growth, (iii)
15     enhance the continued diversification in Illinois' energy
16     resource mix, and (iv) protect the Illinois environment.

1         (2) The Illinois net metering program provides retail
2     rate net metering for systems with a nameplate rating of 40
3     kilowatts and below.
4         (3) The General Assembly finds that it is in the
5     public's best interest to establish a task force to study
6     and evaluate net metering program experiences in other
7     states, examine the status of net metering in Illinois, and
8     determine whether any changes to the statutes concerning
9     Illinois net metering are necessary.
10     (b) The General Assembly establishes the Net Metering Task
11 Force comprised of 16 members to be appointed no later than
12 August 2, 2010 in the following manner:
13         (1) one member appointed by the President of the
14     Senate;
15         (2) one member appointed by the Minority Leader of the
16     Senate;
17         (3) one member appointed by the Speaker of the House of
18     Representatives;
19         (4) one member appointed by the Minority Leader of the
20     House of Representatives;
21         (5) one member appointed by the Attorney General; and
22         (6) 11 members appointed by the Governor, including one
23     representative from the Office of the Governor, one
24     representative from the Illinois Commerce Commission, one
25     representative of the Illinois Power Agency, one
26     representative from the Department of Commerce and

1     Economic Opportunity, one representative from the Citizens
2     Utility Board, one representative from a membership
3     organization representing alternative retail electric
4     suppliers, one representative from the environmental
5     community, one representative from an Illinois public
6     utility serving 2 million or more retail electric
7     customers, one representative from 3 legally affiliated
8     Illinois public utilities serving fewer than 2 million
9     retail electric customers, one representative from a
10     membership organization representing Illinois public
11     utilities, and one representative from a membership
12     organization representing Illinois retail merchants.
13     The Governor shall name a chairperson from among the Task
14 Force appointees.
15     (c) No later than March 1, 2011, the Task Force shall
16 submit a report to the General Assembly concerning the status
17 of net metering in Illinois and whether any legislative and
18 programmatic changes to the existing net metering law are
19 necessary. The Chairperson of the Task Force shall submit a
20 draft report to each of the members of the Task Force at least
21 30 days before submitting the required report to the General
22 Assembly. The members of the Task Force shall discuss the draft
23 report and record any votes taken on its contents. The draft
24 report receiving the approval of a majority of those appointed
25 to the Task Force shall be submitted to the General Assembly.

1 report shall be allowed to submit a minority report for
2 inclusion in the Task Force report. The Task Force report to
3 the General Assembly shall include all minority reports
4 submitted to the Chairperson within 10 business days after the
5 day the Task Force approves the required report.
6     (d) The Task Force report shall include, at a minimum,
7 discussion of the following topics:
8         (1) net metering policies and experiences from other
9     states;
10         (2) the effects associated with expanded net metering
11     development in Illinois, including its impact on renewable
12     and diversified energy development, economic development,
13     job growth, peak electricity consumption, grid operation
14     and maintenance, and the environment;
15         (3) any uneconomic existing barriers to net metering
16     development in Illinois;
17         (4) whether legislation, policies, and other best
18     practices should be implemented to address uneconomic
19     barriers to net metering development in Illinois;
20         (5) the overall consumer costs and rate impacts, if
21     any, associated with implementing these policies,
22     including taking into account the associated benefits of
23     net metering development in Illinois; and
24         (6) an evaluation of the current net metering law to
25     determine how well it is functioning among the
26     participating utilities.

1     (e) The Illinois Commerce Commission shall provide
2 administrative support for the Task Force.
 
3     Section 99. Effective date. This Act takes effect upon
4 becoming law.".
