AMENDMENT TO HOUSE BILL 4239

2     AMENDMENT NO. ______. Amend House Bill 4239, on page 2,
3 line 19, after the period, by inserting ""Licensed
4 establishment" does not include a facility operated by an
5 organization licensee, an intertrack wagering licensee, or an
6 intertrack wagering location licensee licensed under the
7 Illinois Horse Racing Act of 1975 or a riverboat licensed under
8 the Riverboat Gambling Act."; and
 
9 on page 8, line 14, by replacing "A valid" with "Except for a
10 facility operated by an organization licensee, an intertrack
11 wagering licensee, or an intertrack wagering location licensee
12 licensed under the Illinois Horse Racing Act of 1975 or a
13 riverboat licensed under the Riverboat Gambling Act, a valid";
14 and
 
15 on page 10, line 20, by replacing "race track" with "facility
16 operated by an organizational licensee, an intertrack wagering

1 licensee, or an intertrack wagering location licensee"; and
 
2 by replacing line 19 on page 16 through line 13 on page 17 with
3 the following:
 
4     "Section 60. Imposition and distribution of tax.
5     (a) A tax of 25% is imposed on net terminal income and
6 shall be collected by the Board.
7     (b) Of the tax collected under this Section, four-fifths
8 shall be deposited into the School Infrastructure Fund and
9 one-fifth shall be deposited into the Local Government Video
10 Gaming Distributive Fund. Deposits into the School
11 Infrastructure Fund pursuant to this Section shall be allocated
12 in accordance with the provisions of the School Construction
13 Law.
14     (c) Revenues generated from the play of video gaming
15 terminals shall be deposited by the terminal operator, who is
16 responsible for tax payments, in a specially created, separate
17 bank account maintained by the video gaming terminal operator
18 to allow for electronic fund transfers of moneys for tax
19 payment.
20     (d) Each licensed establishment, licensed truck stop
21 establishment, licensed fraternal establishment, and licensed
22 veterans establishment shall maintain an adequate video gaming
23 fund, with the amount to be determined by the Board."; and

1 by replacing line 13 on page 18 through line 13 on page 20 with
2 the following:
 
3     "Section 75. Revenue sharing; Local Government Video
4 Gaming Distributive Fund.
5     (a) As soon as may be after the first day of each month,
6 the Board shall allocate among those municipalities and
7 counties of this State that have not prohibited video gaming
8 pursuant to Section 27 the amount available in the Local
9 Government Video Gaming Distributive Fund, a special fund in
10 the State Treasury, as provided in Section 60. The Board shall
11 then certify such allocations to the State Comptroller, who
12 shall pay over to those eligible municipalities and counties
13 the respective amounts allocated to them. The amount of such
14 funds allocable to each such municipality and county shall be
15 in proportion to the tax revenue generated from video gaming
16 within the eligible municipality or county compared to the tax
17 revenue generated from video gaming Statewide.
18     (b) The amounts allocated and paid to a municipality or
19 county of this State pursuant to the provisions of this Section
20 may be used for any general corporate purpose authorized for
21 that municipality or county.
22     (c) Upon determination by the Board that an amount has been
23 paid pursuant to this Section in excess of the amount to which
24 the county or municipality receiving such payment was entitled,
25 the county or municipality shall, upon demand by the Board,

1 repay such amount. If such repayment is not made within a
2 reasonable time, the Board shall withhold from future payments
3 an amount equal to such overpayment. The Board shall
4 redistribute the amount of such payment to the county or
5 municipality entitled thereto.".
