SYNOPSIS AS INTRODUCED:

625 ILCS 5/6-205.3 new

Amends the Illinois Vehicle Code. Provides that upon a first conviction of resisting or obstructing a peace officer under the Criminal Code of 1961 involving the operation of a motor vehicle, the Secretary of State must suspend the convicted person's driver's license for a period not exceeding 6 months, and upon a second or subsequent conviction of the same offense, the person's driver's license must be suspended for one year. Provides that upon a conviction of resisting or obstructing a peace officer involving the operation of a motor vehicle, the court must order the person to surrender his or her driver's license to the clerk of the court who must forward the suspended license to the Secretary of State. Effective immediately.

A BILL FOR

AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Vehicle Code is amended by adding Section 6-205.3 as follows:

Sec. 6-205.3. Suspension of driver's license of person convicted of resisting or obstructing a peace officer. The driver's license of a person convicted of resisting or obstructing a peace officer under Section 31-1(a) of the Criminal Code of 1961 involving that person's operation of a motor vehicle shall be suspended by the Secretary for a period not to exceed 6 months for a first offense. Upon a second or subsequent conviction for resisting or obstructing a peace officer involving that person's operation of a motor vehicle, the suspension shall be for a period not to exceed one year. Upon conviction of a person for resisting or obstructing a peace officer involving that person's operation of a motor vehicle, the court shall order the person to surrender his or her driver's license to the clerk of the court who shall forward the suspended license to the Secretary of State.

Section 99. Effective date. This Act takes effect upon becoming law.
