| AMENDMENT TO HOUSE BILL 80

| replacing everything after the enacting clause with the | 4 |
| following:

| "Section 5. The School Code is amended by adding Sections | 6 |
| 14-2 and 22-60 and by changing Section 27-24.2 as follows: | 7 |
| (105 ILCS 5/14-2 new) | 8 |
| Sec. 14-2. Definition of general education classroom for | 9 |
| special education students receiving services in the general | 10 |
| education classroom. | 11 |
| (a) With respect to any State statute or administrative | 12 |
| rule that defines a general education classroom to be composed | 13 |
| of a certain percentage of students with individualized | 14 |
| education programs (IEPs), students with individualized | 15 |
| education programs shall exclude students receiving only | 16 |
| speech services outside of the general education classroom, |

| provided that the instruction the students receive in the | 2 |
| general education classroom does not require modification. | 3 |
| (b) In every instance, a school district must ensure that | 4 |
| composition of the general education classroom does not | 5 |
| interfere with the provision of a free and appropriate public | 6 |
| education to any student. | 7 |

| Sec. 22-60. Modification of biodiesel blend requirement. | 9 |
| From the effective date of this amendatory Act of the 96th | 10 |
| General Assembly through July 1, 2012, a school district may | 11 |
| modify, by official board action, the requirement that vehicles | 12 |
| owned or operated by the district use a 5% biodiesel blend by | 13 |
| using a 2% biodiesel blend, notwithstanding Section 12-705.1 of | 14 |
| the Illinois Vehicle Code. | 15 |
| (105 ILCS 5/27-24.2) (from Ch. 122, par. 27-24.2) | 16 |
| Sec. 27-24.2. Safety education; driver education course. | 17 |
| Instruction shall be given in safety education in each of | 18 |
| grades one though 8, equivalent to one class period each week, | 19 |
| and any school district which maintains
grades 9 through 12 | 20 |
| shall offer a driver education course in any such school
which | 21 |
| it operates. Its curriculum shall include content dealing with | 22 |
| Chapters 11, 12, 13, 15, and 16 of the Illinois Vehicle Code, | 23 |
| the rules adopted pursuant to those Chapters insofar as they | 24 |
| pertain to the operation of motor vehicles, and the portions of |

| the Litter Control Act relating to the operation of motor | 2 |
| vehicles. The course of instruction given in grades 10 through | 3 |
| 12 shall include an emphasis on the development of knowledge, | 4 |
| attitudes, habits, and skills necessary for the safe operation | 5 |
| of motor vehicles, including motorcycles insofar as they can be | 6 |
| taught in the classroom, and instruction on distracted driving | 7 |
| as a major traffic safety issue. In addition, the course shall | 8 |
| include instruction on special hazards existing at and required | 9 |
| safety and driving precautions that must be observed at | 10 |
| emergency situations, highway construction and maintenance | 11 |
| zones, and railroad crossings and the approaches thereto. The | 12 |
| course of instruction required of each eligible student at the | 13 |
| high school level shall consist of a minimum of 30 clock hours | 14 |
| of classroom instruction and a minimum of 6 clock hours of | 15 |
| individual behind-the-wheel instruction in a dual control car | 16 |
| on public roadways taught by a driver education instructor | 17 |
| endorsed by the State Board of Education. Both the classroom | 18 |
| instruction part and the practice driving
part of such driver | 19 |
| education course shall be open to a resident or
non-resident | 20 |
| student attending a non-public school in the district wherein | 21 |
| the
course is offered. Each student attending any public or | 22 |
| non-public high school
in the district must receive a passing | 23 |
| grade in at least 8 courses during the
previous 2 semesters | 24 |
| prior to enrolling in a driver education course, or the
student | 25 |
| shall not be permitted to enroll in the course; provided that | 26 |
| the local
superintendent of schools (with respect to a student |

| attending a public high
school in the district) or chief school | 2 |
| administrator (with respect to a
student attending a non-public | 3 |
| high school in the district) may waive the
requirement if the | 4 |
| superintendent or chief school administrator, as the case
may | 5 |
| be, deems it to be in the best interest of the student. A | 6 |
| student may be allowed to commence the
classroom instruction | 7 |
| part of such driver education course prior to reaching
age 15 | 8 |
| if such student then will be eligible to complete the entire | 9 |
| course
within 12 months after being allowed to commence such | 10 |
| classroom instruction. | 11 |
| Such a course may be commenced immediately after the | 12 |
| completion of a prior
course. Teachers of such courses shall | 13 |
| meet the certification requirements of
this Act and regulations | 14 |
| of the State Board as to qualifications. | 15 |
| Subject to rules of the State Board of Education, the | 16 |
| school district may charge a reasonable fee, not to exceed $50, | 17 |
| to students who participate in the course, unless a student is | 18 |
| unable to pay for such a course, in which event the fee for | 19 |
| such a student must be waived. However, from the effective date | 20 |
| of this amendatory Act of the 96th General Assembly through | 21 |
| June 30, 2013, the district may increase this fee to not to | 22 |
| exceed $250 by school board resolution following a public | 23 |
| hearing on the increase, which increased fee must be waived for | 24 |
| students who participate in the course and are unable to pay | 25 |
| for the course. The total amount from driver education fees and | 26 |
| reimbursement from the State for driver education must not |

| exceed the total cost of the driver education program in any | 2 |
| year and must be deposited into the school district's driver | 3 |
| education fund as a separate line item budget entry. All moneys | 4 |
| deposited into the school district's driver education fund must | 5 |
| be used solely for the funding of a high school driver | 6 |
| education program approved by the State Board of Education that | 7 |
| uses driver education instructors endorsed by the State Board | 8 |
| of Education. | 9 |

| Section 99. Effective date. This Act takes effect upon | 11 |
| becoming law.".
