AMENDMENT TO HOUSE BILL 5288

2     AMENDMENT NO. ______. Amend House Bill 5288 on page 5, by
3 inserting after line 25 the following:
4     "(k-1) At an intersection equipped with an automated
5 traffic law enforcement system, the yellow light change
6 interval must be not less than 3 seconds.
7     (k-2) No person shall be charged with a traffic violation
8 or be issued a written notice of violation, as a result of an
9 automated traffic law enforcement system, unless the entire
10 vehicle crosses the stop bar marked on the pavement.
11     (k-3) Except as otherwise provided in this subsection
12 (k-3), an intersection may not be equipped with an automated
13 traffic law enforcement system unless the following
14 requirements have been met:
15         (1) The county or municipality having jurisdiction has
16     determined that the intersection has a high accident rate.
17     Before such a determination is made, the county or
18     municipality must have performed or caused to be performed

1     an evaluation of accident rates for a 6-month period.
2         (2) The county or municipality having jurisdiction
3     has, for a 3-month period, used strobe lights in the red
4     lenses of all traffic signals at the intersection in an
5     attempt to decrease the accident rate without the use of an
6     automated traffic law enforcement system.
7         (3) All roads converging at the intersection are
8     controlled by traffic signals mounted on mast arms.
9     This subsection (k-3) does not apply to counties and
10 municipalities that were authorized to operate automated
11 traffic law enforcement systems before the effective date of
12 this amendatory Act of the 95th General Assembly.".
