AMENDMENT TO HOUSE BILL 4774

2     AMENDMENT NO. ______. Amend House Bill 4774 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Counties Code is amended by adding Section
5 5-1130 as follows:
 
6     (55 ILCS 5/5-1130 new)
7     Sec. 5-1130. Purchase of agricultural conservation
8 easements for farmland preservation. The county board of any
9 county may, by ordinance, acquire one or more agricultural land
10 conservation easements, permanent or definitive, for farmland
11 preservation purposes through the purchase of easements from
12 landowners. The easement rights must limit the use of the land
13 to production agriculture, as defined in Section 3-35 of the
14 Use Tax Act, for a term specified by the ordinance. At least 30
15 days prior to the purchase of any agricultural land
16 conservation easement under this Section, the county board must

1 notify the corporate authorities of any municipality that is
2 located within 1.5 miles of the easement. The corporate
3 authorities of the municipality may, by ordinance, object to
4 the purchase of the easement within 30 days after the
5 notification is received. If the municipality does not object
6 within 30 days, then the county board may purchase the
7 easement. If the municipality does object, then the county
8 board may not purchase the easement for a period of 5 years
9 after the date of the objection.
 
10     Section 10. The Illinois Municipal Code is amended by
11 adding Section 11-153-1 as follows:
 
12     (65 ILCS 5/11-153-1 new)
13     Sec. 11-153-1. Purchase of agricultural conservation
14 easements for farmland preservation. The corporate authorities
15 of any municipality may, by ordinance, acquire one or more
16 agricultural land conservation easements, permanent or
17 definitive, for farmland preservation purposes through the
18 purchase of easements from landowners. The easement rights must
19 limit the use of the land to production agriculture, as defined
20 in Section 3-35 of the Use Tax Act, for a term specified by the
21 ordinance. Any ordinance adopted under this Section requires
22 the approval of the county board of the county in which the
23 easement is located by the affirmative vote of 3/4 of its
24 members.

1     Section 99. Effective date. This Act takes effect upon
2 becoming law.".
