AMENDMENT TO HOUSE BILL 1235

2     AMENDMENT NO. ______. Amend House Bill 1235 by replacing
3 everything after the enacting clause with the following:
 
 
4     "Section 5. The Military Code of Illinois is amended by
5 adding Section 31 as follows:
 
6     (20 ILCS 1805/31 new)
7     Sec. 31. Removal of sensitive material. No employee of the
8 Department of Military Affairs may remove electronic or paper
9 copies of sensitive material from Department offices without
10 the express authorization of the Adjutant General. For the
11 purposes of this Section, "sensitive material" means an
12 individual's first name or first initial and last name in
13 combination with any one or more of the following data
14 elements, when either the name or the data elements are not
15 encrypted or redacted:

1         (1) social security number;
2         (2) driver's license number or State identification
3     card number;
4         (3) account number or credit card or debit card number,
5     or an account number in combination with any required
6     security code, access code, or password that would permit
7     access to an individual's financial account;
8         (4) medical data;
9         (5) military identification number; and
10         (6) official Department of Defense documents,
11     including service records and records of veterans who have
12     passed away.
 
13     Section 10. The Department of Veterans Affairs Act is
14 amended by adding Section 20 as follows:
 
15     (20 ILCS 2805/20 new)
16     Sec. 20. Removal of sensitive material. No employee of the
17 Department of Veterans Affairs may remove electronic or paper
18 copies of sensitive material from Department offices without
19 the express authorization of the Director. For the purposes of
20 this Section, "sensitive material" means an individual's first
21 name or first initial and last name in combination with any one
22 or more of the following data elements, when either the name or
23 the data elements are not encrypted or redacted:
24         (1) social security number;

12     Section 99. Effective date. This Act takes effect upon
13 becoming law.".
