AMENDMENT TO SENATE BILL 3053

2     AMENDMENT NO. ______. Amend Senate Bill 3053 as follows:
 
3 by deleting line 26 on page 3 through line 8 on page 5; and
 
4 on page 1, line 6, after "2,", by inserting "3," and deleting
5 "5"; and
 
6 on page 1, line 12, by changing "$30,958,149,369" to
7 "$31,514,441,299"; and
 
8 on page 2, immediately below line 6, by inserting the
9 following:
 
10     "(30 ILCS 330/3)  (from Ch. 127, par. 653)
11     Sec. 3. Capital Facilities. The amount of $7,876,527,299
12 $7,320,235,369 is authorized to be used for the acquisition,
13 development, construction, reconstruction, improvement,
14 financing, architectural planning and installation of capital
15 facilities within the State, consisting of buildings,
16 structures, durable equipment, land, and interests in land for
17 the following specific purposes:
18         (a) $2,767,519,930 $2,211,228,000 for educational
19     purposes by State universities and colleges, the Illinois
20     Community College Board created by the Public Community
21     College Act and for grants to public community colleges as

1     authorized by Sections 5-11 and 5-12 of the Public
2     Community College Act;
3         (b) $1,607,420,000 for correctional purposes at State
4     prison and correctional centers;
5         (c) $531,175,000 for open spaces, recreational and
6     conservation purposes and the protection of land;
7         (d) $589,917,000 for child care facilities, mental and
8     public health facilities, and facilities for the care of
9     disabled veterans and their spouses;
10         (e) $1,455,990,000 for use by the State, its
11     departments, authorities, public corporations, commissions
12     and agencies;
13         (f) $818,100 for cargo handling facilities at port
14     districts and for breakwaters, including harbor entrances,
15     at port districts in conjunction with facilities for small
16     boats and pleasure crafts;
17         (g) $204,657,000 for water resource management
18     projects;
19         (h) $16,940,269 for the provision of facilities for
20     food production research and related instructional and
21     public service activities at the State universities and
22     public community colleges;
23         (i) $36,000,000 for grants by the Secretary of State,
24     as State Librarian, for central library facilities
25     authorized by Section 8 of the Illinois Library System Act
26     and for grants by the Capital Development Board to units of
27     local government for public library facilities;
28         (j) $25,000,000 for the acquisition, development,
29     construction, reconstruction, improvement, financing,
30     architectural planning and installation of capital
31     facilities consisting of buildings, structures, durable
32     equipment and land for grants to counties, municipalities
33     or public building commissions with correctional
34     facilities that do not comply with the minimum standards of

1     the Department of Corrections under Section 3-15-2 of the
2     Unified Code of Corrections;
3         (k) $5,000,000 for grants in fiscal year 1988 by the
4     Department of Conservation for improvement or expansion of
5     aquarium facilities located on property owned by a park
6     district;
7         (l) $432,590,000 to State agencies for grants to local
8     governments for the acquisition, financing, architectural
9     planning, development, alteration, installation, and
10     construction of capital facilities consisting of
11     buildings, structures, durable equipment, and land; and
12         (m) $203,500,000 for the Illinois Open Land Trust
13     Program as defined by the Illinois Open Land Trust Act.
14     The amounts authorized above for capital facilities may be
15 used for the acquisition, installation, alteration,
16 construction, or reconstruction of capital facilities and for
17 the purchase of equipment for the purpose of major capital
18 improvements which will reduce energy consumption in State
19 buildings or facilities.

22 on page 5, immediately below line 8, by inserting the
23 following:
 
24     "Section 10. The Build Illinois Bond Act is amended by
25 changing Sections 2 and 4 as follows:
 
26     (30 ILCS 425/2)  (from Ch. 127, par. 2802)
27     Sec. 2. Authorization for Bonds. The State of Illinois is
28 authorized to issue, sell and provide for the retirement of
29 limited obligation bonds, notes and other evidences of
30 indebtedness of the State of Illinois in the total principal
31 amount of $3,855,509,000 $3,805,509,000 herein called "Bonds".

1 Such authorized amount of Bonds shall be reduced from time to
2 time by amounts, if any, which are equal to the moneys received
3 by the Department of Revenue in any fiscal year pursuant to
4 Section 3-1001 of the "Illinois Vehicle Code", as amended, in
5 excess of the Annual Specified Amount (as defined in Section 3
6 of the "Retailers' Occupation Tax Act", as amended) and
7 transferred at the end of such fiscal year from the General
8 Revenue Fund to the Build Illinois Purposes Fund (now
9 abolished) as provided in Section 3-1001 of said Code;
10 provided, however, that no such reduction shall affect the
11 validity or enforceability of any Bonds issued prior to such
12 reduction. Such amount of authorized Bonds shall be exclusive
13 of any refunding Bonds issued pursuant to Section 15 of this
14 Act and exclusive of any Bonds issued pursuant to this Section
15 which are redeemed, purchased, advance refunded, or defeased in
16 accordance with paragraph (f) of Section 4 of this Act. Bonds
17 shall be issued for the categories and specific purposes
18 expressed in Section 4 of this Act.

21     Sec. 4. Purposes of Bonds. Bonds shall be issued for the
22 following purposes and in the approximate amounts as set forth
23 below:
24     (a) $2,417,000,000 for the expenses of issuance and sale of
25 Bonds, including bond discounts, and for planning,
26 engineering, acquisition, construction, reconstruction,
27 development, improvement and extension of the public
28 infrastructure in the State of Illinois, including: the making
29 of loans or grants to local governments for waste disposal
30 systems, water and sewer line extensions and water distribution
31 and purification facilities, rail or air or water port
32 improvements, gas and electric utility extensions, publicly
33 owned industrial and commercial sites, buildings used for

1 public administration purposes and other public infrastructure
2 capital improvements; the making of loans or grants to units of
3 local government for financing and construction of wastewater
4 facilities; refinancing or retiring bonds issued between
5 January 1, 1987 and January 1, 1990 by home rule
6 municipalities, debt service on which is provided from a tax
7 imposed by home rule municipalities prior to January 1, 1990 on
8 the sale of food and drugs pursuant to Section 8-11-1 of the
9 Home Rule Municipal Retailers' Occupation Tax Act or Section
10 8-11-5 of the Home Rule Municipal Service Occupation Tax Act;
11 the making of deposits not to exceed $70,000,000 in the
12 aggregate into the Water Pollution Control Revolving Fund to
13 provide assistance in accordance with the provisions of Title
14 IV-A of the Environmental Protection Act; the planning,
15 engineering, acquisition, construction, reconstruction,
16 alteration, expansion, extension and improvement of highways,
17 bridges, structures separating highways and railroads, rest
18 areas, interchanges, access roads to and from any State or
19 local highway and other transportation improvement projects
20 which are related to economic development activities; the
21 making of loans or grants for planning, engineering,
22 rehabilitation, improvement or construction of rail and
23 transit facilities; the planning, engineering, acquisition,
24 construction, reconstruction and improvement of watershed,
25 drainage, flood control, recreation and related improvements
26 and facilities, including expenses related to land and easement
27 acquisition, relocation, control structures, channel work and
28 clearing and appurtenant work; the making of grants for
29 improvement and development of zoos and park district field
30 houses and related structures; and the making of grants for
31 improvement and development of Navy Pier and related
32 structures.
33     (b) $186,000,000 for fostering economic development and
34 increased employment and the well being of the citizens of

1 Illinois, including: the making of grants for improvement and
2 development of McCormick Place and related structures; the
3 planning and construction of a microelectronics research
4 center, including the planning, engineering, construction,
5 improvement, renovation and acquisition of buildings,
6 equipment and related utility support systems; the making of
7 loans to businesses and investments in small businesses;
8 acquiring real properties for industrial or commercial site
9 development; acquiring, rehabilitating and reconveying
10 industrial and commercial properties for the purpose of
11 expanding employment and encouraging private and other public
12 sector investment in the economy of Illinois; the payment of
13 expenses associated with siting the Superconducting Super
14 Collider Particle Accelerator in Illinois and with its
15 acquisition, construction, maintenance, operation, promotion
16 and support; the making of loans for the planning, engineering,
17 acquisition, construction, improvement and conversion of
18 facilities and equipment which will foster the use of Illinois
19 coal; the payment of expenses associated with the promotion,
20 establishment, acquisition and operation of small business
21 incubator facilities and agribusiness research facilities,
22 including the lease, purchase, renovation, planning,
23 engineering, construction and maintenance of buildings,
24 utility support systems and equipment designated for such
25 purposes and the establishment and maintenance of centralized
26 support services within such facilities; and the making of
27 grants or loans to units of local government for Urban
28 Development Action Grant and Housing Partnership programs.
29     (c) $1,102,358,100 $1,052,358,100 for the development and
30 improvement of educational, scientific, technical and
31 vocational programs and facilities and the expansion of health
32 and human services for all citizens of Illinois, including: the
33 making of construction and improvement grants and loans to
34 public libraries and library systems; the making of grants and

1 loans for planning, engineering, acquisition and construction
2 of a new State central library in Springfield; the planning,
3 engineering, acquisition and construction of an animal and
4 dairy sciences facility; the planning, engineering,
5 acquisition and construction of a campus and all related
6 buildings, facilities, equipment and materials for Richland
7 Community College; the acquisition, rehabilitation and
8 installation of equipment and materials for scientific and
9 historical surveys; the making of grants or loans for
10 distribution to eligible vocational education instructional
11 programs for the upgrading of vocational education programs,
12 school shops and laboratories, including the acquisition,
13 rehabilitation and installation of technical equipment and
14 materials; the making of grants or loans for distribution to
15 eligible local educational agencies for the upgrading of math
16 and science instructional programs, including the acquisition
17 of instructional equipment and materials; miscellaneous
18 capital improvements for universities and community colleges
19 including the planning, engineering, construction,
20 reconstruction, remodeling, improvement, repair and
21 installation of capital facilities and costs of planning,
22 supplies, equipment, materials, services, and all other
23 required expenses; the making of grants or loans for repair,
24 renovation and miscellaneous capital improvements for
25 privately operated colleges and universities and community
26 colleges, including the planning, engineering, acquisition,
27 construction, reconstruction, remodeling, improvement, repair
28 and installation of capital facilities and costs of planning,
29 supplies, equipment, materials, services, and all other
30 required expenses; and the making of grants or loans for
31 distribution to local governments for hospital and other health
32 care facilities including the planning, engineering,
33 acquisition, construction, reconstruction, remodeling,
34 improvement, repair and installation of capital facilities and

1 costs of planning, supplies, equipment, materials, services
2 and all other required expenses.
3     (d) $150,150,900 for protection, preservation, restoration
4 and conservation of environmental and natural resources,
5 including: the making of grants to soil and water conservation
6 districts for the planning and implementation of conservation
7 practices and for funding contracts with the Soil Conservation
8 Service for watershed planning; the making of grants to units
9 of local government for the capital development and improvement
10 of recreation areas, including planning and engineering costs,
11 sewer projects, including planning and engineering costs and
12 water projects, including planning and engineering costs, and
13 for the acquisition of open space lands, including the
14 acquisition of easements and other property interests of less
15 than fee simple ownership; the acquisition and related costs
16 and development and management of natural heritage lands,
17 including natural areas and areas providing habitat for
18 endangered species and nongame wildlife, and buffer area lands;
19 the acquisition and related costs and development and
20 management of habitat lands, including forest, wildlife
21 habitat and wetlands; and the removal and disposition of
22 hazardous substances, including the cost of project
23 management, equipment, laboratory analysis, and contractual
24 services necessary for preventative and corrective actions
25 related to the preservation, restoration and conservation of
26 the environment, including deposits not to exceed $60,000,000
27 in the aggregate into the Hazardous Waste Fund and the
28 Brownfields Redevelopment Fund for improvements in accordance
29 with the provisions of Titles V and XVII of the Environmental
30 Protection Act.
31     (e) The amount specified in paragraph (a) above shall
32 include an amount necessary to pay reasonable expenses of each
33 issuance and sale of the Bonds, as specified in the related
34 Bond Sale Order (hereinafter defined).

1     (f) Any unexpended proceeds from any sale of Bonds which
2 are held in the Build Illinois Bond Fund may be used to redeem,
3 purchase, advance refund, or defease any Bonds outstanding.
