AMENDMENT TO HOUSE BILL 3031

AMENDMENT NO. ______. Amend Amend House Bill 3031 by replacing the title with the following:

"AN ACT concerning health."; and

by replacing everything after the enacting clause with the following:

"Section 5. The Children's Mental Health Act of 2003 is amended by adding Section 20 as follows:

(405 ILCS 49/20 new)

Sec. 20. Mandatory screening and testing prohibited. Nothing contained in this Act shall be construed to authorize or require mandatory mental health screenings or testing of a pregnant woman or a child against the wishes of the pregnant woman or of the child's parent or legal guardian. Mental health screening or testing of a child may not be authorized or required without the written permission of the child's parent or legal guardian.

Nothing contained in this amendatory Act of the 94th General Assembly shall be construed to supersede the intent of Section 3-501 of the Mental Health and Developmental Disabilities Code.

Section 99. Effective date. This Act takes effect upon becoming law.".
