AMENDMENT TO HOUSE BILL 2010

2     AMENDMENT NO. ______. Amend House Bill 2010 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The School Code is amended by changing Section
5 13A-8 as follows:
 
6     (105 ILCS 5/13A-8)
7     Sec. 13A-8. Funding.
8     (a) The State of Illinois shall provide funding for the
9 alternative school programs within each educational service
10 region and within the Chicago public school system by line item
11 appropriation made to the State Board of Education for that
12 purpose. This money, when appropriated, shall be provided to
13 the regional superintendent and to the Chicago Board of
14 Education, who shall establish a budget, including salaries,
15 for their alternative school programs. Each program shall
16 receive funding in the amount of $30,000 plus an amount based
17 on the ratio of the region's or Chicago's best 3 months'
18 average daily attendance in grades pre-kindergarten through 12
19 to the statewide totals of these amounts. However, if
20 $19,035,500 or more is appropriated in a fiscal year for
21 alternative school programs, then each program shall instead
22 receive funding in the amount of $50,000 plus an amount based
23 on the ratio of the region's or Chicago's best 3 months'
24 average daily attendance in grades pre-kindergarten through 12

1 to the statewide totals of these amounts. For purposes of the
2 funding this calculation, the best 3 months' average daily
3 attendance for each region or Chicago shall be calculated by
4 adding to the best 3 months' average daily attendance the
5 number of low-income students identified by the Department of
6 Human Services and averaged over the 3 immediately preceding
7 fiscal years, in the most recently available federal census
8 multiplied by one-half times the percentage of the region's or
9 Chicago's low-income students to the State's total low-income
10 students. The State Board of Education shall retain up to 1.1%
11 of the appropriation to be used to provide technical
12 assistance, professional development, and evaluations for the
13 programs.
14     (a-5) Notwithstanding any other provisions of this
15 Section, each for the 1998-1999 fiscal year, the total amount
16 distributed under subsection (a) for an alternative school
17 program shall be not less than the total amount that was
18 distributed under that subsection for that alternative school
19 program for the 2005-2006 1997-1998 fiscal year. If an
20 alternative school program is to receive a total distribution
21 under subsection (a) for a given the 1998-1999 fiscal year that
22 is less than the total distribution that the program received
23 under that subsection for the 2005-2006 1997-1998 fiscal year,
24 that alternative school program shall also receive, from a
25 separate appropriation made for purposes of this subsection
26 (a-5), a supplementary payment equal to the amount by which its
27 total distribution under subsection (a) for the 2005-2006
28 1997-1998 fiscal year exceeds the amount of the total
29 distribution that the alternative school program receives
30 under that subsection for the given 1998-1999 fiscal year. If
31 the amount appropriated for supplementary payments to
32 alternative school programs under this subsection (a-5) is
33 insufficient for that purpose, those supplementary payments
34 shall be prorated among the alternative school programs

1 entitled to receive those supplementary payments according to
2 the aggregate amount of the appropriation made for purposes of
3 this subsection (a-5).
4     (b) An alternative school program shall be entitled to
5 receive general State aid as calculated in subsection (K) of
6 Section 18-8.05 upon filing a claim as provided therein. Any
7 time that a student who is enrolled in an alternative school
8 program spends in work-based learning, community service, or a
9 similar alternative educational setting shall be included in
10 determining the student's minimum number of clock hours of
11 daily school work that constitute a day of attendance for
12 purposes of calculating general State aid.
13     (c) An alternative school program may receive additional
14 funding from its school districts in such amount as may be
15 agreed upon by the parties and necessary to support the
16 program. In addition, an alternative school program is
17 authorized to accept and expend gifts, legacies, and grants,
18 including but not limited to federal grants, from any source
19 for purposes directly related to the conduct and operation of
20 the program.

24     Section 99. Effective date. This Act takes effect July 1,
25 2005.".
