1 AN ACT in relation to handguns.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Department of State Police Law of the
5 Civil Administrative Code of Illinois is amended by adding
6 Section 2605-560 as follows:
7 (20 ILCS 2605/2605-560 new)
8 Sec. 2605-560. Handgun ballistics identification.
9 (a) In this Section:
10 "Handgun" has the meaning ascribed to it in clause (h)
11 (2) of Subsection (A) of Section 24-3 of the Criminal Code of
12 1961.
13 "Manufacturer" means any person who possesses a valid
14 federal license issued by the United States Secretary of the
15 Treasury that permits that person to engage in the business
16 of manufacturing firearms or ammunition for the purpose of
17 sale or distribution.
18 "Projectile" means that part of handgun ammunition that
19 is, by means of an explosion, expelled through the barrel of
20 the handgun.
21 "Shell casing" means that part of handgun ammunition that
22 contains the primer and propellant powder to discharge the
23 projectile.
24 (b) Any manufacturer that ships or transports a handgun
25 to be sold, rented, or transferred in this State shall
26 include in the box with the handgun in a separate sealed
27 container:
28 (1) A shell casing of a projectile discharged from
29 that handgun; and
30 (2) additional information that identifies the type
31 of handgun and shell casing as required by the Director

1 of State Police to meet the provisions of this Section.
2 (c) Upon receipt of a handgun from the manufacturer, the
3 dealer shall confirm to the Department of State Police that
4 the manufacturer complied with the provisions of subsection
5 (b).
6 (d) Upon the sale or transfer of the handgun, the dealer
7 shall forward the sealed container to the Department of State
8 Police crime laboratory.
9 (e) Upon receipt of the shell casing and required
10 information, the Department of State Police crime laboratory
11 shall enter the information in a computer database.
12 (f) The Director of State Police shall promulgate rules
13 to carry out the provisions of this Section.
14 Section 99. Effective date. This Act takes effect January
15 1, 2004.
