 1                    AMENDMENT TO SENATE BILL 1021

 2        AMENDMENT NO.     .  Amend Senate Bill 1021 by  replacing
 3    everything after the enacting clause with the following:

 4        "Section 5. The University Credit and Retail Sales Act is
 5    amended  by  changing Section 0.01 and adding Section 0.05 as
 6    follows:

 7        (110 ILCS 115/0.01) (from Ch. 144, par. 251.9)
 8        Sec. 0.01.  Short title.  This Act may be  cited  as  the
 9    Higher  Education  Institution  University  Credit and Retail
10    Sales Act.

12        (110 ILCS 115/0.05 new)
13        Sec. 0.05.  State institution of higher learning defined.
14    "State institution of higher learning"  means  a  university,
15    college,  community  college, or junior college in this State
16    that is publicly supported  by  taxes  levied  and  collected
17    within  the  State  on  income,  sales,  or  property. "State
18    institution of higher learning" does not  include  a  private
19    institution  of  higher  education as that term is defined in
20    Section 3.07 of the Illinois Educational Facilities Authority
21    Act.

 1        Section 90.  The State Mandates Act is amended by  adding
 2    Section 8.27 as follows:

 3        (30 ILCS 805/8.27 new)
 4        Sec.  8.27.  Exempt  mandate.  Notwithstanding Sections 6
 5    and 8 of this Act, no reimbursement by the State is  required
 6    for  the  implementation  of  any  mandate  created  by  this
 7    amendatory Act of the 93rd General Assembly.

 8        Section  99.   Effective date. This Act takes effect upon
 9    becoming law.".
