 1                    AMENDMENT TO SENATE BILL 994

 2        AMENDMENT NO.     .  Amend Senate Bill 994  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.   The  Department  of  Human Services Act is
 5    amended by changing Section 80-5 and the Article  80  heading
 6    as follows:

 8          ARTICLE 80. EVALUATION AND TRANSITION PROVISIONS

10        Sec. 80-5. Task Force on the Department of Human Services
11    Consolidation.
12        (a)  There  is  hereby  established  a  Task Force on the
13    Department of Human Services Consolidation.
14        (b)  The Task Force shall consist of 7 voting members, as
15    follows: one person appointed  by  the  Governor,  who  shall
16    serve  as chair of the Task Force; 2 members appointed by the
17    President of the Senate, one of whom shall  be  designated  a
18    vice  chair  at the time of appointment; one member appointed
19    by the Senate Minority Leader; 2  members  appointed  by  the
20    Speaker of the House of Representatives, one of whom shall be
21    designated  a  vice chair at the time of appointment; and one

 1    member appointed by the House Minority Leader.
 2        Members appointed by the  legislative  leaders  shall  be
 3    appointed for the duration of the Task Force; in the event of
 4    a  vacancy, the appointment to fill the vacancy shall be made
 5    by the legislative leader of the same house and party as  the
 6    leader  who  made the original appointment.  The Governor may
 7    at any time terminate the service of the person appointed  by
 8    the  Governor  and  reappoint  a different person to serve as
 9    chair of the Task Force.
10        The following persons (or their designees)  shall  serve,
11    ex  officio,  as  nonvoting  members  of  the Task Force: the
12    Director of Public Health, the Director of  Public  Aid,  the
13    Director of Children and Family Services, the Director of the
14    Bureau  of  the  Budget, and the Secretary of Human Services,
15    until their offices are abolished,  the  Director  of  Mental
16    Health   and  Developmental  Disabilities,  the  Director  of
17    Rehabilitation Services, and the Director of  Alcoholism  and
18    Substance Abuse.  The Governor may appoint up to 3 additional
19    persons  to serve as nonvoting members of the Task Force, who
20    may be technical consultants  from;  such  persons  shall  be
21    officers  or  employees  of  a  constitutional office or of a
22    department or agency of the executive branch.
23        The Task Force may begin to  conduct  business  upon  the
24    appointment  of  a  majority  of  the voting members.  If the
25    chair has not been appointed but both vice chairs  have  been
26    appointed,  the  2 vice chairs shall preside jointly.  If the
27    chair has not been appointed and only one vice chair has been
28    appointed, that vice chair shall preside.
29        Members shall  serve  without  compensation  but  may  be
30    reimbursed for their expenses.
31        (c)  The  Task  Force  shall  gather information and make
32    recommendations relating to the performance of  the  Illinois
33    Department  of  Human  Services since its creation under this
34    Act, with respect to its success in achieving the  goals  and

 1    objectives   of   the   human   services  consolidation,  the
 2    effectiveness of its structure and function, and  its  impact
 3    on   the   delivery   of  programs  and  services.  planning,
 4    organization,   and   implementation   of   human    services
 5    consolidation.   The Task Force shall work to assure that the
 6    human services delivery system is meeting meets and  adhering
 7    adheres  to the goals of quality, efficiency, accountability,
 8    and financial  responsibility;  to  make  recommendations  in
 9    keeping  with  those  goals concerning the design, operation,
10    and organizational structure of the new Department  of  Human
11    Services;   and   to  recommend  any  necessary  implementing
12    legislation for the  improvement  of  programs  and  services
13    under the jurisdiction of the Department of Human Services.
14        The  Task Force shall evaluate monitor the implementation
15    of human service program reorganization and shall  study  its
16    effect  on  the  delivery  of  services  to  the  citizens of
17    Illinois.  The Task Force shall make recommendations  to  the
18    Governor and the General Assembly regarding the effect of the
19    future consolidation of human service programs and functions.
20        (d)  The Task Force shall:
21             (1)  review   and   make   recommendations   on  the
22        organizational structure of the new Department  of  Human
23        Services;
24             (2)  review  the  status  of and approve plans for a
25        unified electronic management and intake information  and
26        reporting system as provided in Section 1-25, and monitor
27        and guide the implementation of the system;
28             (3)  review  the  progress  that  the Department has
29        made toward and make recommendations on the consolidation
30        or elimination of fragmented or duplicative programs;
31             (4)  monitor  and  review  the  progress  that   the
32        Department has made on maximizing make recommendations on
33        how  best  to maximize future federal funding for the new
34        Department of Human Services, with specific  specifically

 1        including consideration of any federal Medicaid, welfare,
 2        or  block  grant  reforms  that  have  been authorized to
 3        enhance State programs and services reform;
 4             (5)  review the progress  that  the  Department  has
 5        made    and    make    recommendations    on   geographic
 6        regionalization;
 7             (6)  review the progress  that  the  Department  has
 8        made  and  make  recommendations  on  the  development of
 9        common intake and client confidentiality processes;
10             (7)  review the progress  that  the  Department  has
11        made  with  respect  and  make  recommendations to foster
12        effective community-based privatization; and
13             (8)  obtain a management audit of the Department  of
14        Children   and  Family  Services,  to  be  completed  and
15        submitted to the Task Force no later than July  1,  1997;
16        and
17             (8)  (9)  review  any  other  appropriate matter and
18        make recommendations to assure a high quality, efficient,
19        accountable, and financially responsible system  for  the
20        delivery of human services to the people of Illinois.
21        (e)  The  Task  Force  may  hire  any  necessary staff or
22    consultants, enter into contracts, and make any  expenditures
23    necessary  for  carrying  out  its  duties, all out of moneys
24    appropriated for that purpose.  Staff support services may be
25    provided to the Task Force by the Office of the Governor, the
26    agencies of State government represented on the Task Force by
27    ex officio members directly involved in the reorganization of
28    the delivery of human services, and  appropriate  legislative
29    staff.
30        (f)  The  Task  Force may establish an advisory committee
31    to ensure maximum public participation in  the  Task  Force's
32    planning,  organization,  and  implementation review process.
33    If established, the advisory committee shall (1)  advise  and
34    assist  the Task Force in its duties, (2) help the Task Force

 1    to identify issues of public concern, and (3) meet  at  least
 2    quarterly.
 3        (g)  The  Task  Force shall submit preliminary reports of
 4    its findings and recommendations  to  the  Governor  and  the
 5    General  Assembly by January 1, 2004 and March 1, 2004, and a
 6    final report by  September  1,  2004  February  1,  1997  and
 7    February  1,  1998 and a final report by January 1, 1999.  It
 8    may submit other reports as it deems appropriate.
 9        (h)  The Task Force  is  abolished  on  January  1,  2005
10    February 1, 1999.

12        Section  99.  Effective date.  This Act takes effect upon
13    becoming law.".
