 1                    AMENDMENT TO SENATE BILL 268

 2        AMENDMENT NO.     .  Amend Senate Bill 268,  AS  AMENDED,
 3    in  Section  5,  Sec.  21,  subsection  (w), by replacing the
 4    sentence  that  begins  "This  subsection   (w)"   with   the
 5    following:
 6    "This  subsection  (w)  shall  not  apply  to (1) a permitted
 7    pollution  control  facility  that   transfers   or   accepts
 8    construction  or  demolition  debris,  clean  or  general, or
 9    uncontaminated  soil  for  final  disposal,   recycling,   or
10    treatment,  (2)  a public utility (as that term is defined in
11    the Public Utilities Act) or a municipal utility, or (3)  the
12    Illinois  Department of Transportation, or (4) a municipality
13    or a county highway department, with  the  exception  of  any
14    municipality  or  county  highway department located within a
15    county having a population of over 3,000,000  inhabitants  or
16    located  in  a county that is contiguous to a county having a
17    population of over 3,000,000 inhabitants; but it shall  apply
18    to  an  entity  that  contracts  with  a  public  utility,  a
19    municipal    utility,   or   the   Illinois   Department   of
20    Transportation,  or  a  municipality  or  a  county   highway
21    department.".
