AMENDMENT TO HOUSE BILL 5057

2     AMENDMENT NO. ______. Amend House Bill 5057 on page 7, by
3 replacing lines 4 though 35 with the following:
 
4     "(20 ILCS 105/4.12 new)
5     Sec. 4.12. Assistance to nursing home residents.
6     (a) The Department on Aging shall assist eligible nursing
7 home residents and their families to select long-term care
8 options that meet their needs and reflect their preferences. At
9 any time during the process, the resident or his or her
10 representative may decline further assistance.
11     (b) To provide assistance, the Department shall develop a
12 community reintegration program in selected areas of the State,
13 to be expanded statewide as funding becomes available. The
14 program shall be developed in consultation with nursing homes,
15 case managers, Area Agencies on Aging, and others interested in
16 the well-being of frail elderly Illinois residents. The
17 Department shall establish administrative rules pursuant to
18 the Illinois Administrative Procedure Act with respect to
19 resident eligibility, assessment of the resident's health,
20 cognitive and social needs, development of comprehensive
21 service transition plans, and the level of services that must
22 be available prior to reintegration of a resident into the
23 community.
 
24     Section 10. The Illinois Public Aid Code is amended by

1 adding Section 5-5d as follows:
 
2     (305 ILCS 5/5-5d new)
3     Sec. 5-5d. Community reintegration. The Department of
4 Public Aid shall apply for any necessary waivers pursuant to
5 Section 1915(c) of the Social Security Act to facilitate
6 community reintegration. Nothing in this Section shall be
7 construed as limiting current reintegration programs by the
8 Departments of Human Services or the Department on Aging."; and
 
9 on page 8, by deleting lines 1 through 27.
